Police arrest man for using “senile” grandma in gangster video www.privateofficer.com

www.privateofficer.com – Authorities say that they received information about an elderly woman appearing in a gangster style video that was making it’s way around the internet and officers were concerned about who was starring in it.
Police say that they conducted a routine traffic stop on a vehicle and discovered the video. Officers seized it at that time for further investigation.
Investigators identified the actors in the video as Alfinez, Christopher Garcia, 18, and Corey Lunford, 19. The three are seen taking turns shooting the semi-automatic pistol from the moving car, the report said.Lunford, of West Palm Beach, was arrested March 25 and charged with discharging a firearm from a vehicle.In interviews with detectives, Lunford and Alfinez admitted that the woman was also in the Gangstas & Thugs video. Alfinez said he made the footage after he was contacted by Gangstas & Thugs producer Raymond “Raylo” Hartley.Hartley denied Tuesday knowing who the woman was. He said when he was making his series, Alfinez sent him footage of both the woman and some fights from Wellington. He said there was nothing on the tape indicating the woman was coerced and he included it for the “shock value.”"They probably took what we did and tried to exceed it and do more,” Hartley said, adding that he thought the video was stupid.Alfinez also told detectives that he got the idea from Gangstas & Thugs.
A judge released him on supervised release the next day. Garcia is now in the military out of state, said Sheriff’s Office spokesman Paul Miller.
Police say that they have charged an 18-year-old man with elder abuse for having his senile grandmother wear a black mask and hold a handgun for a video on thug life in Palm Beach County.
The 85-year-old woman is seen and heard on the video threatening to shoot “all the pigs,” referring to police.Michael Alfinez was arrested Monday and charged with abusing an elderly person, discharging a firearm in public and improper exhibition of a dangerous weapon. Authorities say Alfinez also appears on the video firing a gun from a moving vehicle driving around the city.
Palm Beach County sheriff’s detectives seized the video during a traffic stop in January. Court records do not list an attorney for Alfinez.
His mother, Michelle, calls the incident a misunderstanding.

Deputy commits suicide while under investigation www.privateofficer.com
WEST PALM BEACH FLA. April 24 2008 – A Palm Beach County sheriff’s deputy who committed suicide after setting fire to his car and apartment was facing possible charges in connection with the fatal shooting of someone he said he pulled over, Sheriff Ric Bradsaw said today.
Samuel Peixoto, 38, whose body was found this morning at the Windward Villages apartments, had not been truthful with details on the March 15 stop, Bradshaw said.
The Sheriff’s Office was working with the State Attorney’s Office and planned to go to the grand jury with charges that would have included manslaughter and tampering with evidence, Bradshaw said.”There was indications he knew this and could not handle the situation,” Bradshaw said
However, Bradshaw said there was no sign Peixoto would take his own life.Peixoto pulled over a minivan at Casa Del Monte mobile home park west of West Palm Beach, and arrested a driver who had a suspended license, the Sheriff’s Office said at the time.
He was responding to a call about a suspicious vehicle there.When the deputy approached the van’s passenger, there was an argument and the passenger, Marina Ramos, 35, slashed the deputy’s left hand, Peixoto told authorities.The Sheriff’s Office said Peixoto reported firing his gun several times in self-defense, killing Ramos.
Peixoto, who had been a deputy since April 2006, was placed on administrative leave while the agency investigated. An internal affairs probe later found problems in Peixoto’s story, Bradshaw said.Police were called to apartment K in building 500 at 1441 Brandywine Road after firefighters found Peixoto’s body this morning, police Capt. Pat Maney said.
Peixoto apparently set his car on fire, then went inside and set his apartment on fire before shooting himself in the head, Maney said.
He may have set the fire to cover up his suicide, Maney said.
Fire-Rescue spokesman Phil Kaplan said firefighters extinguished the blaze before it spread to other apartments.Neighboring apartments may have had smoke and water damage.

Security officer critical after hit by car www.privateofficer.com

Bealls distribution center was critically injured today when a vehicle struck and rolled on top of him, the Florida Highway Patrol reported.
Bradenton resident John W. Sherrill Jr, a uniform security officer,. tried to stop a vehicle about 3:50 p.m. at the department store chain’s distribution center, 2100 47th Terr. E. According to the trooper’s report, Sherrill wanted to stop a driver to let traffic go through a parking lot.
The driver, Rene Rios Ferrara, 53, of Sarasota, for unknown reasons, accelerated his vehicle into Sherrill’s path, according to FHP reports.
Sherrill was pinned under the car as fire rescue was called and when emergency crews arrived he was still under the vehicle in bad shape
He was flown to Bayfront Medical Center in St. Petersburg with critical injuries.
Ferrara was cited for careless driving.

Retail Association employee charged with theft www.privateofficer.com

The next time the Maryland Retailers Association warns its members about the dangers of employee theft, the organization won’t have to look far for an example.
Sandra Kay Oliver, a former employee of the association based on Conduit Street in Annapolis, faces 11 charges of felony theft alleging she stole “hundreds of thousands of dollars” from the MRA since 1998, according to court documents.
Deputy State’s Attorney William Roessler noted the “elaborate” nature of the theft scheme, but declined to elaborate on it before the 78-day trial scheduled to begin Oct. 6 in front of Circuit Court Judge Pamela North.
“I think it is unprecedented,” Mr. Roessler said of the three-month trial. “I don’t think we have ever had a criminal trial … last more than two or three weeks, even death penalty murder cases.”
The judge alone will determine Ms. Oliver’s innocence or guilt. There will not be a jury.
Each charge carries the possibility of 15 years in prison and $25,000 in fines.
Details of how and when police think Ms. Oliver, who worked in the association’s financial and membership services division, stole the money are not available. Tom Saquella, president of the association, and prosecutors declined to comment Friday and court records provided few particulars – or even a total amount.
According to numerous defense motions seeking the release of different bills and records, the state alleges Ms. Oliver used the company credit card and checkbook to make hundreds of unauthorized payments to different businesses.
Charging documents said the thefts began as early as May 4, 1998, and continued until at least May 31, 2005. Ms. Oliver, 51, was charged June 26, 2006.
Samuel J. Brown, Ms. Oliver’s attorney, argued in court documents that all of the credit card charges were “authorized” and “directly related to MRA business.”
To prove that, however, Mr. Brown said he needed copies of the individual bills and receipts.
“The charges go back to 1998 and the defendant’s memory needs to be refreshed by documents from the company’s with whom MRA did business,” he wrote.
To prove the case against Ms. Oliver, Mr. Roessler said, experts will sift through dozens of boxes of files on the stand and explain to the judge exactly where the money went.
“I think the word to describe it will be tedious. … One piece of paper being described after another,” he said. “There are so many files. It’s going to take weeks.”
Mr. Brown thinks the 78-day trial on the docket is overkill, that prosecutors won’t need as much time as they think.
“I think it takes two weeks to try this case,” he said.
Plea negotiations are ongoing, but the defense Friday was not optimistic they would be able to reach a deal.
“It appears this case may go to trial,” Mr. Brown said. He said the state wants too much in restitution, but he declined to say how much they were willing to accept in a plea agreement.
Last month, Judge North set an April 30 deadline for Ms. Oliver to accept or reject the plea. She said the case was creating “significant” problems in the scheduling of other cases.
If the case goes to trial, it would effectively take one of the county’s 11 circuit court judges out of service for the months of October, November and December, as well as one of the county’s prosecutors.
“My concern is, if you wait until the day of trial to advise me of any plea, then the remaining (77) days are lost at the cost of scheduling many other cases,” Judge North said.

Authorities in this small South Alabama community announced that two former top-level Loxley officials, including a police chief who served the department for more than 20 years, were arrested Monday on charges they illegally tapped confidential records.
The allegations involved as many as 18 different victims, according to Alabama Attorney General Troy King’s Office.
Former Chief Cliff Bradley Yetter Jr. was charged with nine felony counts of “willfully obtaining or seeking to obtain criminal records through Law Enforcement Tactical System under false pretenses that it was for an official law enforcement or criminal justice purpose.”
The town’s former court clerk and magistrate, Kay Hicks, who was arrested at a Robertsdale funeral home, faces 11 felony counts of the same charge.
Yetter faces two counts of unauthorized use of a computer to obtain the criminal records, while Hicks faces nine counts of the misdemeanor.
Authorities are not releasing much detail about the records the two tried to obtain but the allegations against Yetter involved eight people and the charges against Hicks involved at least 10 different people, according to Attorney General’s Office spokeswoman Joy Patterson.
“It is particularly serious when a police chief and a court official are accused of violating the laws they were entrusted to enforce and protect,” King said in a prepared statement. The timeframe of the alleged violations was not released.
According to police, Hicks was arrested at Mack Funeral Home in Robertsdale while making funeral arrangements for her mother, who died Saturday, according to Huey Mack Sr., who owns the company.
“She was handcuffed, put in the car and taken to the Baldwin County jail,” Mack said. “I witnessed it myself.”
The agents allowed her to finish her business that she was there to conduct, and once she did she went with them willingly,” Alabama Criminal Justice Information Center spokeswoman Lynn Childs said.
The Daphne home address Hicks had provided to agents with the Justice Information Center was a vacant lot, according to Childs. Authorities soon learned that Hicks actually had no permanent address, Childs said. Details about when Hicks left employment with the town were not available Monday.
Yetter, authorities say was arrested at his home in Loxley.
The Loxley Police Department faced scrutiny during Yetter’s tenure. He was named acting chief in 1999 and took over full time a year later.
In 2003, a female officer alleged that fellow Loxley officers had sexually harassed her and tampered with evidence, but then-Baldwin County District Attorney David Whetstone said he could not substantiate the allegations. Yetter told the town council in November 2006 that he wanted to step down.
There has been a lot of turmoil in that little police department an official said. It has to make you wonder if it’s a leadership problem.
Two months later, as the city was searching for his re placement, Yetter recommended the firing of his former assistant, Al Adkins.
After Yetter’s first replacement served only six months, John “Chip” Cason took over as the town’s chief in November 2007.
If convicted of the charges, Yetter and Hicks both could serve up to five years in prison and be ordered to pay as much as $10,000 on each of the felony counts. The misdemeanor charges carry punishment of up to a year in jail and $6,000 fines for each count.
Yetter and Hicks were released from the Baldwin County Corrections Center on Monday afternoon on $5,000 bail..

Police arrest teen in jewelry robbery www.privateofficer.com
Zainesville Ohio April 24 2008
A Columbus juvenile who police say has been the focus of an investigation of a jewelry heist at a department store is in custody and has been charged in connection with the the robbery of over $50,000 worth of jewelry from the store.
Assistant Licking County Prosecutor Erin Welch says a 15-year-old boy, whose name is not yet being released, was arraigned in court Monday on aggravated robbery charges.
Investigators say that the charges stem from a March 24th smash and grab style robbery at the Kohl’s department store in Newark.
Welch says two suspects implied they had a gun and scooped up the merchandise before fleeing the store.
Authorities are still investigating and searching for the accomplice in the case.

Firefighter arrested for shoplifting while on duty www.privateofficer.com

In this small community just across the Ohio River from Cincinnati, some folks are surprised, while a few others say they are outraged at the arrest of a Covington firefighter who now stands accused of shoplifting.
Police say that the firefighter stoled from a local grocery store while on duty and in uniform.
Covington police were called to a grocery store last week and cited Donald Studer, a city firefighter, for theft, after allegedly stealing $6 worth of cold medicine that he did not pay for.
A witness at the Kroger at 15th and Madison, said Studer placed the merchandise in his left pocket and left the store.
The 19-year-veteran firefighter is also facing an internal investigation and discipline.
The City of Covington did not say if Studer has been suspended or if he would remain on duty pending his court appearance.

Shoplifter flees with electronics www.privateofficer.com
STAFFORD NJ. April 24 2008 — A Pennsylvania man has been charged with pocketing electronics items from two stores here after he tried to run a similar scam in Toms River Monday night.
Police say Christopher J. Preg, 20, of Kunkletown, would approach store clerks and ask to view video game merchandise, then swipe the items while distracting store employees.
He is believed to have taken an X-Box game system from the Route 72 Wal-Mart in late March and three Play Station Portables from Kmart, also on Route 72, on April 8.
He was taken into custody on Monday after an employee at Kmart on Route 37 alerted Toms River police about a person attempting to take electronics items.
After an investigation that included reviewing security footage from Wal-Mart, he was arrested and charged with the two earlier thefts.
Preg was charged with three counts of shoplifting and remains lodged in Ocean County Jail in Toms River in lieu of $5,000 bail.

Teens steal condoms to sell at school www.privateofficer.com

www.privateofficer.com Police say that three Las Cruces teenagers were taken into custody Friday after allegedly shoplifting condoms and pregnancy test kits that they say were to sell at a local middle school.
Las Cruces police responded to call of shoplifters at a local supermarket on Walton Boulevard after a loss prevention officer spotted three girls allegedly shoplifting the items. The store security agent stopped and detain the three until police could arrive.
Police report all three girls admitted skipping school — one from Las Cruces High School and two from Camino Real Middle School.
The girls also reportedly admitted to shoplifting the items to sell at Camino Real, which they said they had done in the past.
Police declined to name the three suspects or their ages but additional charges could be filed in this matter an officer said.

Fake Priest Tracked Down By Marshal’s www.privateofficer.com

The white collar that he wore around his neck as he walked the halls of hospitals had everyone fooled even hospital security and police. As he made his way through the facilities, police say that the man of cloth was a devil in disguise and left behind a trail of victims.
But thanks to the U.S. Marshal’s, Leslie Earl Raymond ended his “priestly duties” in Las Vegas with a pair of bracelets and chains tied around him after being arrested on numerous felony warrants.
Raymond of no certain address, traveled from California to the Mississippi Gulf Coast pretending to be a priest and a man of God. As he made his way through dozens of states, authorities say that he spent his time stealing from many as he lived a life of lies.
When 40-year-old Mark Gramm went to the hospital for a check up, he never imagined the bizarre turn his visit would take. It was June 15, 2007, a sunny day in Sioux Falls, S.D.
As doctors performed tests on Mark, he suddenly passed out. Nurses quickly wheeled him to an emergency room to stabilize him. And while a nurse was checking on Mark, a priest walked in. “I thought to myself, I must be in really bad shape,” Mark tells us.
The priest was wearing a jacket, which Mark found strange, because it was warm outside. But he figured the priest may be visiting some cold places inside the hospital, so he didn’t question it. The priest only talked to Mark for about five minutes and then left.
A few hours later, Mark was released and when he reached for his wallet on his back pocket, he didn’t find it. Mark thought it may have fallen while he was wheeled to the emergency room, so nurses and physicians started searching for it with no luck.
Then Mark remembered: aside from medical personnel, the priest was the only one who had been in contact with him. Hospital employees went to check on the hospital’s security camera and at that point, Mark got a call from his credit card company — his credit cards had been used at several businesses in Sioux Falls.
But police in Sioux Falls were able to identify the man who took Mark’s wallet as 38-year-old Leslie Earl Raymond. They say Raymond impersonated a priest and walked into the emergency room at Sanford Hospital in Sioux Falls saying he was there to visit some patients. Apparently he randomly targeted Marked and walked into his room.
That’s when he noticed that Mark’s clothes were accessible, went for the pants and took the wallet. Cops say the jacket may have helped him hide the wallet.
After the hospital visit, Sioux Falls detectives say Raymond went to different stores and bought a pre-paid cell phone and a multi-colored male Wire Fox Terrier puppy. At at least one of the locations he identified himself as James Kennedy.
Authorities in Tyler Texas say that their citizens also had the misfortunes of meeting the fake priest who they have sought for alleged thefts from an area hospital.
Police say that the arrest comes almost a year after he allegedly took wallets from patients and a nurse at hospitals in four states.
Kilgore Texas police say a clerical-collar-wearing man pretended to minister to patients last July at Kilgore’s Laird Hospital.
Authorities later determined that a 78-year-old patient had his credit card stolen. The fake priest was caught on security video at a Kilgore pharmacy, using the credit card to buy 800 dollars worth of gift certificates.
And police also want him in at least six states and there may other victims in other states that police have not connected the dots to Raymond yet a police agent said. We’ve put the word out to law enforcement agencies in all the states that he might have traveled through and I’m sure by the end of the week we’ll get other calls about this guy’s disceptive and stealing ways the agent said.

Police investigate shooting of shoplifter www.privateofficer.com

www.privateofficer.com Authorities from the Steubenville Police Department are investigating the shooting of a shoplifting suspect.
Police today identified the man as 56-year-old Michael Chapman who is charged with robbery.
According to authorities, just after 8:00 p.m. Friday, a Steubenville Police officer was dispatched to the Hollywood Shopping Plaza because of a shoplifter call
The tape of the 911 call that started it all was released and at first, it came across the lines like any other run, on any other night.
“Jefferson County 911, what is your emergency,” said the 911 dispatcher.
“A Lady at the Kroger told me to call, they have a shoplifter here,” said a 911 caller.
But in seconds, the voice on the wire gave more details of what they said went on.
“One of the people working here, this white guy just swung at her…,” said the 911 caller on the tape.
Then upon response to the scene, at the Kroger police said the pace picked up even more.
As the officer was pulling up to the store, Chapman took off and was chaed into nearby woods.
The police department’s press release stated that “the officer ‘engaged’ with the suspect and ended up discharging his duty weapon striking him one time.”
The suspect is recovering in a Pittsburgh hospital.
The Jefferson County Sheriff’s Department and the Bureau of Criminal Identification and Investigation are also investigating the matter.
In the meantime, both the suspect and an officer are off the streets.
Police tell us the suspect is in stable condition, and the officer who fired the shot at him is on paid leave, but the department said the reasoning is strictly protocol
The name of the officer involved in the shooting has not been released.

www.privateofficer.com A 24-year-old Wilmington man is wanted by state police for allegedly trying to sell $600 worth of stolen DVDs to a retail store in Brandywine Hundred.State police said Joseph W. Nester, of the 200 block of N. DuPont St., will be charged under a recently enacted statute, “Organized retail crime with 2+ previous convictions,” which makes it a felony for someone with at least two previous convictions to “steal quantities [of merchandise] that would not normally be purchased for personal use with the intent to re-sell it.
“Troopers were called Thursday to the FYE store in the Concord Mall after a man tried to sell a number of DVDs, said state police spokesman Cpl. Jeff Whitmarsh.
The staff grew suspicious, so they obtained the man’s identification but then declined to purchase the items, said Whitmarsh, who added that when a store asks for ID during such a transaction, it “greatly aids law enforcement officers and helps to curb this type of criminal behavior.”
Troopers identified the suspect as Nester and determined that the DVDs had been stolen earlier that day from the Border’s Books and Music store at 4221 Concord Pike, Whitmarsh said.

The Florida Department of Law Enforcement (FDLE) has arrested a former employee of the Florida Department of Education (FDOE) following an investigation into allegations that she used the personal information of co-workers to obtain online loans.
According to authorities, the FDOE discovered that the employee now identied as Tiffanie Hooley, 29, had allegedly used her position as an accountant in their comptroller’s office to access state payroll records for the purpose of securing loans.
Her employment at the FDOE was terminated in December.
The FDOE turned the case over to FDLE and provided assistance throughout the investigation.
The investigation revealed that between July and December 2007, Hooley secured, or attempted to secure, at least nine loans totaling $6,700 through different online “payday” or “cash advance” lenders using the identities of three former or current FDOE employees.
Once the loans were approved the funds were deposited directly into Hooley’s bank account through electronic transfer.
Hooley, from Tallahassee, surrendered herself at the Leon County Jail this week and was charged with nine counts of criminal use of personal identification information (identity theft), a third-degree felony.
Bond was set at $9,000.
Each count carries a maximum sentence of up to five years in prison.
No state funds were misappropriated as a result of the scheme.

Two men believed to have stolen tens of thousands dollars worth of clothing from area malls from Chicago to Livingston County are in police custody after being caught stealing from the Tanger outlet mall on Burkhart Road.
Sheriff Bob Bezotte said today that Oakland County undercover officers with assistance from FBI were trailing to the two men Thursday afternoon after receiving a tip that the men were in a red rental car and hitting area malls from Chicago to Madison Heights.
Bezotte said officers observed the two men — identified only as 27- and 37-year-old men with driver’s licenses from Puerto Rico — walk into the stores with empty bags and walk out less than three minutes later with a bag full of clothing
The men were stopped near Interstate 96 exit ramp to the mall and police confiscated nearly $2,000 worth of clothing stolen from Gap and about $1,200 in clothing stolen from Dress Barn.
Police also seized $400 in cash as well as maps and diagrams police say marked the spots the two men hit.The men were believed to be staying at a hotel in the Madison Heights area.
Additional details were not immediately available as police continue to investigate this organized theft ring.

www.privateofficer.com — A large amount of marijuana is off the streets after a sting in Wilson County, police said.
Wilson County Sheriff Terry Ashe referred to the sting as another major drug bust.
Officers seized more than 100 pounds of pot, about $40,000 in cash, muscle cars and other items in the sting.
Ashe said tips led police to the Lebanon home of 61-year-old Richard Swigert on Monday night. Police said they used a reverse sting and went undercover to find Swigert and 41-year-old Terry Grisham dealing drugs.
Authorities said a lot of the marijuana was growing in the bedroom of Swigert’s 11-year-old son.
“The bad in this pretense, which is the father, has no respect for his children. And growing them up in an environment where they’re also going to be involved in this type of activity exposing them to the criminal element. Hopefully, the district attorney will take that situation into effect when he starts pursuing charges against these people,” Ashe said.
While the items have been seized, neither man has been arrested or charged with anything because police are in the process of sending the evidence to a grand jury for possible indictments.
Officers said they would also be looking into the bank accounts of both men because police believe there could be more money that was funneled through the drug operation.
“If you’re dealing 100 pounds of dope at one time, there’s potential to have a lot of money out there that has yet to be tracked down,” Ashe said.
The grand jury is expected to hand down indictments by the end of next week.

www.privateofficer.com – Police say a Delmar man arrested for shoplifting in Salisbury was later found to have warrants on him for check forgery and theft.
Salisbury police say on Wednesday, police received a call to respond to the Giant Food Store in reference to a shoplifter.
Investigators say upon arrival, employees of the business advised that Richard Ray Mason, 49, of Delmar, Md. had been caught as he tried to take alcoholic beverage from the business without paying.
Police say after the arrest, the suspect was found to be wanted on an outstanding arrest warrant obtained by Salisbury detectives charging the suspect with check forgery and theft.
Mason was charged with theft, issuance of false document and forgery of private document. Mason was released to central booking.
