It seems crime even hits crime fighters.
An off-duty Jefferson County sheriff’s deputy returned to his Pelham home after work and interrupted a burglary at his residence.
According to police, when the deputy made entry into his home he was was shot in the shoulder by the burglar.
It happened Saturday night in the 1900 block of Old Montgomery Highway.
Police and deputy sheriff units responded to the scene and searched for the shooter but did not locate him.
The name of the wounded deputy has not been released but he is expected to make a full recovery.
Police are still searching for the burglary suspect.

San Jose police say they have busted the “Shotgun Bandits,” using a sergeant’s hunch about a lover’s loyalties
Last month, a group of masked robbers went on a dangerous spree, police said, bursting into at least seven businesses armed with a sawed-off shotgun and snatching fistfuls of cash from the registers as employees and customers cowered in fear.
But investigators eventually caught up with the suspected robbers, after a sergeant became suspicious about a manager at one of the targets – a lingerie store called Cupid’s Corner.
Jessica Tovar, a 22-year-old San Jose woman, is being held on $200,000 bail. She is charged with one felony count of robbery. Her boyfriend, Michael Washington, 25, faces up to 85 years in jail on 16 counts of felony robbery. He is being held with no bail.
Another suspect, Gabriel Navarro, 26, is charged with three felony counts of robbery. He is also being held on $200,000 bail. All three, who were in Santa Clara County Superior Court this week, are scheduled to enter a plea next week.
The armed-takeover robberies – rare and dangerous crimes – began at a Little Caesars pizzeria March 28. By the beginning of April, the so-called Shotgun Bandits had hit five other businesses: another Little Caesars, two Subways, a Pizza Hut and a Taco Bell. They were all in a swath of southwest San Jose except one – a Subway nearby in Campbell.
And oddly, at the climax of the night of April 2 during which the bandits robbed two fast-food joints within half an hour, they hit Cupid’s Corner, known for its sexy lingerie. That didn’t fit any pattern. But security videotapes confirmed it was the bandits.
Patrol and robbery units began to stake out fast-food restaurants in the area, trying to figure out where the bandits would strike next.
Meanwhile, Sgt. Michael Montonye – in charge of the cases – began focusing on a longtime employee at Cupid’s Corner. Why did she seem so relaxed, facing down two men in black and a sawed-off shotgun? Why hadn’t she pressed the store’s panic button?
“She looked too calm,” Montonye said.
Further investigation showed she had a boyfriend, an ex-convict who seemed to closely fit the description of one of the robbers.
Looking at the pattern of robberies, Sgt. Dave Newman, a supervisor with the San Jose Police MERGE unit – also known as the SWAT team – began staking out the Malone Road home with his team. He knew the bandits always struck right about 9 p.m., always on a Wednesday or a Friday.
But soon Newman figured they were too dangerous not to watch full time.
Good thing, too, because the robbers hit again April 17 – a Thursday – this time another Subway sandwich shop.
Minutes after the robbery, two of the suspects – who police identified as Washington and Navarro – pulled up in the driveway where Tovar and Washington lived. Newman’s team moved in.
When they arrested them and began searching the vehicle, police found wads of stolen money. Navarro allegedly told them: “The shotgun isn’t in my vehicle. I don’t know where it is, but it isn’t in my truck. My prints aren’t in it.”
The officers hadn’t asked him about the shotgun, according to police.
On Tovar and Washington’s bed in plain view was a hold-up costume police had seen several times in the surveillance tapes of the robberies: a hoodie and a black Oakland Raiders beanie with eye holes cut out.
The shotgun was propped up near the closet. It was loaded.
“That’s not a gun used for hunting,” Montonye said.
Washington told arresting investigators he was on his way to pick up Tovar at Cupid’s Corner.
Police picked her up instead.

www.privateofficer.com Rogersville police arrested a local woman Saturday for allegedly attempting to shoplift some intimate apparel and a pair of scissors from Wal-Mart while under the influence of drugs.
A police search of Mary Franice Smith, 39, 114 Poplar Drive, Rogersville, also allegedly revealed her to be in possession of a variety of pills.
Wal-Mart theft prevention employee Charles Johnson reported to the Rogersville Police Department that he witnessed Smith stealing “a pair of breast enhancers and a pair of scissors” Saturday shortly before 5 p.m.
Upon his arrival at Wal-Mart, RPD Officer Kenneth Ferguson allegedly observed Smith to be “very unsteady on her feet with very slurred speech.”
Among Smith’s possessions allegedly seized when she was arrested was a green bottle containing several different pills.
Ferguson stated in his report that Smith allegedly had four pills believed to be Oxycodone, three pills believed to be Aprazolam and seven pills believed to be Carisoprodol.
Smith was charged with violation of the Tennessee Drug Control Act, theft under $500, public intoxication, simple possession of Schedule II narcotics, simple possession of Schedule III narcotics and simple possession of Schedule IV narcotics.
She is scheduled for arraignment in Hawkins County Sessions Court on May 14.

A police officer is in trouble over the use of a racial slur and it’s not who you might think it is.
According to city officials, an officer was heard using racial slurs and the conversation was broadcast over a live microphone which has resulted in the suspension a Murfreesboro officer.
Capt. Carl Watkins was handed a three-day suspension for using the “N” word in a conversation.
Watkins, who is black, was on duty when the incident happened in February.
The slur was broadcast over his police radio.
During the subsequent investigation, Watkins explained that he was talking to friends and it was “a term of endearment.” Supervisors weren’t ahppy about the language nonetheless and handed down a suspension without pay and in addition to the suspension, Watkins must attend cultural diversity training.

Two bouncers at a downtown San Jose nightclub were arrested early Friday morning after a police officer allegedly observed the pair punching a man who was on the ground in a parking lot.
A police officer on patrol spotted two men, who were wearing security shirts from Motif Restaurant and Club, repeatedly punching a man who was on the ground, according to police spokesman Jermaine Thomas.
Police arrested San Jose residents Armando Cervantes, 22, and Matthew Martinez, 34, on suspicion of fighting in public.
Cervantes, who reportedly fled on foot after officers approached the scene, was also booked on suspicion of resisting arrest. The Santa Clara County District Attorney’s Office will determine if the men should be charged; they could face assault and battery charges, Thomas said.
A phone message at Motif was not immediately returned.
The closing-time incident started as six to eight security employees of Motif, at 389 S. First St., were attempting to clear out a parking lot at Second and San Carlos streets, Thomas said. The bouncers allegedly told the victim to move along. When he didn’t, the situation escalated.
“These guys started punching,” Thomas said.
The victim sustained no visible injuries, Thomas said.

DECATUR, Ga. May 8 2008 DeKalb County police say a man accused of sexually assaulting two women by using the popular Web site Craigslist to lure them to a vacant apartment is HIV-positive.
Eighteen-year-old Allen Jamar McDowell is accused in two separate assaults at an apartment near his home in March and April.
Police spokeswoman Mekka Parish said Tuesday one woman was raped and the other robbed and sexually assaulted at the vacant apartment at 3527 Kensington Road.
Investigators think there are other victims and are urging them to call the the DeKalb County Special Victims Unit at (770) 724-7710.
McDowell was arrested April 19. He also is charged under a reckless conduct law which applies to people who know they have the virus which causes AIDS.
Parish says she does not know the extent of the victims’ risk of infection.
McDowell remains in custody. It’s not clear whether he has an attorney.

www.privateofficer.com The University of Nevada, Reno police have announced that they are establishing a force of reserve officers to help patrol the campus and assist during special events and emergencies.
According to university officials, the idea has been considered for years, but is timely because of recent sexual assaults, rowdy football fans and tragedies on other college campuses.
The department will recruit, hire and train about 20 applicants to serve as part-time police officers.
University administrators have allocated money for the first year for reserve officers, who will be paid from $15 to $20 an hour, depending on experience.
The agency currently as 24 sworn, full-time positions, 3 of which are vacant.
But this is not a new idea to in the college policing field. Many other colleges and universities use student officers and other part time volunteer staff to help keep their campuses safe.
Just recently, police departments across the nation have brought back the concept of auxiliary or reserve police officers to help provide a variety of services usually at no costs to the citizens since these officers work for free.
The city of Buffalo New York and several departments in Connecticut are considering implimenting a volunteer force in light of budget cuts, rising crime and limited staffing.
Prior to the late 90’s, many departments had beefed up patrols, manned special events like parades and carnivals and festivals, traffic assignments and holiday patrolling with these officers but abolished them because of liabilty concerns over training, officer authority and the coast of the required training that some states were beginning to require.
The use of these people are good for our community and there are thousands of active reserve and auxiliary forces nationwide, James Kitz, a police chief said. Look at he city of New york, they utilize thousands of auxiliary officers that donate tens of thousands of hours patrolling the city at no cost to the city.
With the budget shortfalls and a lack of manpower that most law enfoprcement agencies are facing, I think that we should hire, train and deploy these citizen helpers in every community and use them where we can Kitz said.

Police say a security officer in plain clothes shot a man at a check cashing store on Tuesday.
According to police,the shooting happened just after 10 a.m. at the Check Into Cash on East 6th Avenue and Chambers Road. Aurora Police say the security officer, who was not in uniform, coincidentally walked into the store at the same time as a robbery suspect.
When the suspect pulled out a handgun, the security officer confronted the suspect, shooting him at least once, possibly twice, in the body.
Aurora Police Detective Robert Friel said that dispatchers received a robbery alarm from the Check Into Cash location at East 6th Avenue and Chambers Road shortly after 10:00 a.m. When officers arrived, the security officer had already shot the robbery suspect.
Friel said it’s not known whether the security officer was on duty at another business close by. Workers at nearby stores said there have been robberies in the past and that Check Into Cash had added a guard for protection.
“We’re just trying to gather information about what occurred in those critical moments,” Friel said. According to police, the suspect’s is in serious condition.
He was transported to a local hospital and his identity was not immediately known. It is unclear if anyone else inside the store was hurt.
Police are not releasing the security officers name and have not yet determined whether charges will be filed in the shooting.

Shootings are justifiable if lives are in eminent danger a police officer said. “That will take some time to determine; whether or not this was a justified shooting,” Friel said. Police said they will study surveillance tape from inside the store to see just what happened when the shooting occurred.

A seemingly routine traffic accident took a bizarre twist Friday evening in East San Jose when a naked driver allegedly took on two police officers who were trying to arrest him.
An 18-year-old man, who was spotted running naked on a city street following an auto accident, allegedly became violent when police arrived on the scene. The naked man allegedly charged the officer, who shot him with a Taser “a few times,” and was eventually taken into custody by police after a brief struggle, according to police spokesman Jermaine Thomas.
The driver, Jonathan Wafer, 18, of San Jose, was arrested on suspicion of driving under the influence, resisting arrest, taking an officer’s weapon and being under the influence.
About 10:45 p.m., Wafer allegedly crashed his black sport-utility vehicle into a tree on Quimby Road. A patrol officer responding to the scene saw Wafer, with no clothes on, getting back into the vehicle.
Wafer, who was ordered to get out of the SUV, briefly followed the officer’s orders, Thomas said. Told to lay on the ground, Wafer allegedly charged the officer, who used the Taser on him. A fight broke out, Thomas said, and the officer Tased Wafer a few more times.
“When someone gets Tased and they continue to fight, that shows their strength,” Thomas said. “The Taser is very effective.”
A second officer arrived at the scene and joined the struggle. As the officers tried to handcuff Wafer, one of their batons fell to the ground.
Wafer allegedly picked it up and attempted to hit one of the officers. The other officer grabbed Wafer’s arm, and the two officers finally took him into custody.
Wafer was arrested and transported by ambulance to a local hospital.

Pine Lawn leaders plan to do that with police patrolling in golf carts.
“I think it would be a good idea to do that,” Pine Lawn resident Edward Simms said.
“We’re concerned about security, feeling safe in our own home and feeling a part of the community,” Pine Lawn Resident Mary Wurtz said. “This will help.”
The police chief says the golf carts cost less than a cruiser, they use no gas and most importantly they put police in the community.
“I have officers riding up and down the streets on cell phones. I have officers with the windows up. And this here gives us an opportunity to be more accessible to the public,” Pine Lawn Police Chief Rickey Collins said. In a community of 4500 people, they expect more contact with the police and a little bit more personal service than you might in a big city.
Collins says in addition to police presence and building trust, these allow officers to quietly and quickly get where cars can’t, like in breezeways.
The carts are quiet, so officers can sneak up on suspected criminals more easily.
“The element of surprise with these golf carts is what’s going to keep our community safe, Collins said.
And with one of their officers shot at just a few weeks ago, police safety is a concern too. But officials say this is no more dangerous than other patrols.
“You’re sitting out in the open wherever you go when you’re a police officer. I mean whether your in a car, walking the beat or riding a 10-speed, you’re still in harms way,” he said.
Neighboring community, County Club Hills, has had a cart for seven years. It’s police chief believes in it.
“It’s easier to approach a golf cart. You don’t have the iron doors and everything around you than it is a lot of times with a patrol car,” Country Club Hills Police Chief Cliff Ware said.
The mayor wants the patrols to start next month. The carts will cost $5,000, which will come out of the city budget.

PHOENIX AZ. May 8 2008— A CBS 5 investigation found convicted felons in charge of keeping students safe.
Security guards at Valley high schools interact closely with students, but some have arrest records for crimes like auto theft, assault, shoplifting and lying to police.
One former security guard told 5 Investigates he witnessed guards taking bribes from students, fighting with students and stealing from the school.
He said all of those guards had criminal recordsInvestigates requested the names of all security guards from six Valley school districts and ran the names through a criminal background check. A dozen had criminal records, with convictions including assault, transporting drugs, disorderly conduct and unlawful discharge of a firearm.
“School districts are just bringing anybody off the street that applies for a job and giving them a job,” the former guard said.
Four of the six districts had hired security guards with criminal histories. Paradise Valley has one; Scottsdale has one; Peoria has three; and the Phoenix Union High School district has seven.
Trevor Browne High School employs Michael Nerini, who has an assault conviction.
Maryvale High school employs three ex-convicts as security guards: Vincent Stevenson, convicted of endangering lives with a gun; Theartis McKelvey, convicted of fighting in public; and Moises Longoria, convicted of resisting arrest.
In every case, district officials admitted they knew about the criminal convictions but hired the employees anyway.
The former security guard said administrators have such a hard time filling those positions that they tend to look the other way.
“There’s a kind of a, just kind of ‘mind your own business’ type of attitude,” the former guard said.
The school districts are not breaking any laws by hiring those people. While teachers and administrators need to be cleared by the state to work at public schools, security guards do not.
Security guards are fingerprinted and run through background checks, but it’s up to the school districts to decide whether a conviction should keep them from working.
“That’s not our call on the uncertified. That’s up to the hiring board to deal with,” said Lt. James Warriner of the Department of Public Safety.
That discretion allowed Saguaro High School in Scottsdale to hire Daniel Auditor, a man convicted of stealing a car and threatening and intimidating, causing bodily injury.
The former security guard who spoke with 5 Investigates said the bottom line is that people with criminal records set the wrong example for students and have proven they don’t work well in pressure situations.
“Parent’s need to know exactly who’s in their schools, who’s working in those schools with their kids,” the former guard said.
The school districts said hiring decisions are made on an individual basis and that the guards they employ have shown they are qualified for the job.
Interestingly, to be certified as a security guard by the state of Arizona, a person must pass a background check. Schools are not required to hire state-certified security guards.

Note: While allegations were made by a former security officer, none was ever proven to be true or accurate other than the security officers who were hired with criminal records.

Also, the Phoenix schools reported no problems with these employees and as pinted out during the investigation, the schools hired within their guidelines and broke no laws.
It should also be noted that local police agenies do hire some police officers who have had prior criminal offenses.

~ Will use AMBER Alert technology to enlist public’s help in locating alleged offenders ~
Governor Charlie Crist today signed an Executive Order directing the immediate broadcast of information to the public relating to offenders who have allegedly killed or seriously injured a law enforcement officer in the line of duty. Governor Crist signed Executive Order 08-81 today during the Law Enforcement Officers Memorial Service held in the Capitol Courtyard. The broadcast information will appear on highway message signs and other advisories, alerting the public to report information about suspects.
Today we honor the fallen officers who have given their lives in service to the people of Florida, as well as their families who bravely face each new day without their loved one,” Governor Crist said. “I am honored to sign this Executive Order to help ensure that those who would seek to do harm to our officers are brought to justice.”
The Executive Order directs the Department of Transportation, the Department of Highway Safety and Motor Vehicles and Florida Highway Patrol to coordinate with the Florida Department of Law Enforcement to use technology similar to what is already being used for AMBER Alerts, which notify the public when a child is reported missing. As a result of the alerts, the public has played a vital role in helping law enforcement to safely recover children.
Today’s ceremony, hosted by Florida State Lodge Fraternal Order of Police, honored the 16 Florida law enforcement officers who lost their lives in the line of duty during 2007. Fallen officers honored during the memorial service are as follows:

OFFICE OF THE GOVERNOREXECUTIVE ORDER NUMBER 08-81
WHEREAS, law enforcement officers provide unselfish service to the State; and
WHEREAS, in 2007, sixteen law enforcement officers were killed in the line of duty in Florida; and
WHEREAS, criminals who have committed these heinous crimes frequently take flight and pose a substantial risk to the community; and
WHEREAS, a coordinated law enforcement response coupled with the prompt and widespread sharing of information during these incidents is critical; and
WHEREAS, one of the best ways to protect our citizens is through the coordinated partnership of state agencies;
NOW, THEREFORE, I, CHARLIE CRIST, Governor of Florida, pursuant to the Constitution and laws of the State of Florida, do hereby promulgate the following Executive Order, effective immediately:
Section 1.
The Department of Transportation and the Department of Highway Safety and Motor Vehicles, Florida Highway Patrol are directed to coordinate with the Florida Department of Law Enforcement to immediately broadcast critical information about an offender or offenders who have killed or seriously injured a law enforcement officer to the general public via dynamic highway message signs and other advisory methods as deemed appropriate and available to these agencies. Teacher arrested for smoking pot at school www.privateofficer.com

www.privateofficer.com Police say a Waukegan school teacher is facing drug charges after she allegedly was caught smoking marijuana in the teachers’ lounge at her school. According to Waukegan Police Commander Wayne Walles, 46-year Deborah Logan of Evanston surrendered to police Monday after she was named in a warrant for unlawful possession of marijuana. She was later released on bond.
Walles says security officials at the Waukegan Township High School Upper Grade Center received a complaint that someone was smoking marijuana in the teachers’ lounge and confronted Logan when she left a bathroom there on April 22nd.
He says security officials found marijuana in her purse.
School security officers confiscated the drugs and released the teacher but later secured an arrest warrant for her.

There is no word right now whether or not Logan was allowed to return to her teaching position or if she has been suspended.
