SPRINGFIELD MO Aug 7 2008 — CoxHealth said late Wednesday afternoon that one of its security officers, Monte Ruby, died from being kicked by an injured arrestee. Ruby was in a coma from Saturday afternoon from injuries to his brain stem and spine on Saturday afternoon.
Police said Ruby was trying to calm Jeffrey Bolden, who was agitated, unruly and handcuffed to a Cox North hospital bed while being treated for bites from a Springfield police dog. A city police officer accompanied Bolden to the hospital.

City police arrested Bolden earlier Saturday for assaulting his father and trying to set himself and his father’s home on fire. Police said Bolden couldn’t get a lighter to work after he doused himself in gasoline.

Bolden fled from his father’s home when police showed up. He hid in a brushy lot and police sent a dog in to find and subdue him.

Greene County prosecutors charged Bolden on Monday with assaulting a police officer. They’ll now consider manslaughter or murder charges against him.

Ruby had a state peace officer’s commission through the Greene County Sheriff’s Department. In addition to working at Cox North, he also worked at Ozarks Technical Community College’s Richwood Valley campus in Ozark.

On Tuesday, Greene County prosecutors also charged Bolden with beating his girlfriend with a cordless phone, a barbecue fork and his fists last January. They said Springfield police sent a report on that assault in February but prosecutors hadn’t had time to consider charges until now.

The charges filed on Tuesday are one count of first-degree domestic assault, one count of armed criminal action and two counts of second-degree domestic assault. The 41-year-old man also has previous charges and convictions for assaults, illegal drugs, felonious restraint, and unlawfule use of a weapon.

When Bolden was arrested on Saturday, there was a six-month-old warrant for his arrest for an assault on a neighbor last November.

The federal agent was fatally shot outside a busy post office in Pembroke Pines after a fight, and dozens of police officers searched the area for the gunman, the police said. The Customs and Border Protection agent died at a Fort Lauderdale hospital, said Sgt. Brian Davis, a police spokesman.

The agent, Donald Pettit, 52, was with his young daughter when he was shot, said Carlos Baixauli, a spokesman for the Bureau of Alcohol, Tobacco, Firearms and Explosives.

SACRAMENTO, Calif. Aug 7 2008 — A man shot one person to death and then killed himself when confronted by a security guard early Wednesday in south Sacramento, police said.
Police received a report at 2:39 a.m. of shootings at an apartment complex in the 6700 block of Sunnyslope Drive, sheriff’s Sgt. Tim Curran said.
Deputies arrived to find a 27-year-old white man lying in a parking lot and suffering from multiple gunshot wounds. Paramedics took the man to a local hospital where at 3:20 a.m. he was pronounced dead.
A 32-year-old Asian man with a gunshot wound was found a short distance away in the doorway of an apartment. He was pronounced dead at the scene, Curran said.
Curran added that detectives believe the Asian man shot the first man and then shot himself. Names of the men were not immediately available.
The first man, who lived at the complex with his family, was getting into a vehicle when he was approached by the second man and shot without provocation, Curran said.
As the Asian man was returning to his apartment, he was approached by an armed security guard who works at the complex. Curran said the man shot himself when he was confronted by the guard.
A motive for the shooting has not been determined.
Investigators do not believe the shootings were gang-related. It was unclear if the two dead men knew one another.

ATLANTA GA. Aug. 7 2008 — Fulton County officials said a woman died while waiting for help that was delayed because a 911 operator sent emergency responders to the wrong address.
Fulton County’s 911 director Alfred Moore said it began Saturday afternoon when Darlene Dukes called 911 for help because she was “in respiratory distress.”
Moore said the 911 operator misheard the address Dukes gave and sent crews to Wells Street in Atlanta when Dukes was actually at home on Wales Street in Johns Creek, north of Atlanta.
Moore said the operator should have noticed that the call was coming from a cell tower in north Fulton County, not Atlanta.
The mistake caused a 25-minute delay in response.
Moore said the 911 operator has been fired.

Authorities here are crediting an alert security officer at the Natchez Drive Wal-Mart who tipped off police, which led to an arrest of a Tennessee woman Monday evening for the possession of two grams of methamphetamine.

Shonda D. Stafford, 37, of Johnsonville, Tenn., was also charged with possession of precursors for the creation of methamphetamine, possession of drug paraphernalia, not using her turn signal, expired license plate, expired motor vehicle inspection sticker and no driver’s license, said Slidell Police Department spokesman Capt. Kevin Foltz.

Police say that Monday afternoon, their department was alerted by Wal-Mart security that Stafford had allegedly purchased a large amount of pseudoephedrine, a common over-the-counter allergy medicine used in the manufacture of methamphetamine, which is a highly addictive stimulant.

An unmarked unit was dispatched and the loss prevention agent pointed out Stafford to them. The detectives followed Stafford out of the store and to her 2000 white Ford Explorer. They continued to tail her in their car.

In the 1300 block of Gause Boulevard, according to the police report, Stafford allegedly did not use her left turning signal when making a turn, and officers pulled her over.

Officers questioned the driver and Stafford was arrested when she could not produce a driver’s license or any form of identification.

Detectives searched her vehicle and found two grams of methamphetamine.

Police also found lithium batteries, coffee filters, crystal drain cleaner, the pseudoephedrine and a propane torch.

Foltz said all these materials are commonly used to create and package methamphetamine.

Stafford was booked for several felonies in Slidell and transferred to the St. Tammany Parish Jail to await a bond hearing.

Police say that it was an excellent tip and good information from the security officer who they did not want to name that led to a good solid felony arrest.

http://www.privateofficer.com/ A Charleston man was arrested early Saturday after crashing into the gate leading to the Governor’s Mansion and leaving the scene on three wheels.
Mark Anthony McLane, 45, of 3814 Staunton Ave., was charged with aggravated driving under the influence after Charleston police said his blood alcohol content was 0.237, the criminal complaint filed in magistrate court showed.
McLane had allegedly driven his green Lexus SUV up Virginia Street and then kept coming toward Governor’s Drive, immediately across the street, said Jay Smithers, Capitol Protective Services director.
McLane’s vehicle first struck a large concrete flower planter around 3 a.m., which blew out the left front tire, Smithers said.
“The force from that took him into the gate,” Smithers said.
The electronic gate is still being installed and Smithers said it is currently about 75 percent operational. The crash caused damage to the sliding section of the gate.
While a security guard watched from a nearby guard shack, McLane then pulled out and sped off, Smithers said. The guard called 911 and police were issued an all-points bulletin to watch for the green SUV
At Brooks Street, the three-wheeled vehicle finally played out and officers arrested McLane.
It was the third time in the past two years someone has struck the gate, Smithers said.
“That intersection has always been a major problem for us, especially in the middle of the night,” Smithers said.
That area is heavily illuminated, and drivers have, at times, mistaken it for a continuation of Virginia Street, Smithers said.
Under West Virginia law, 0.08 is considered legally intoxicated. State lawmakers added an additional penalty of “aggravated DUI” for those with a blood alcohol content higher than 0.2.
McLane was charged earlier this summer with failure to pay $782 for workers’ compensation coverage for employees of McMoon Bagels, whose home address was listed in the Secretary of State’s Office as 509 42nd St., Charleston. He was charged with not paying for 2008′s first quarter.
But papers filed with the secretary of state showed McLane founded the firm in 2004, when he was listed as the group’s “organizer” and listed his address as 509 42nd St. The information also shows the firm was disbanded in 2005.

http://www.privateofficer.com Fargo’s police chief says the city is exploring the idea of hiring a private security firm for parking enforcement around the North Dakota State University campus.

Chief Keith Ternes says city police and the university public safety department have shared the responsibility for years.

But he says resources are stretched now, and police don’t have the personnel to enforce the rules consistently.

But Ternes says “farming out” parking enforcement around the campus is still only in the discussion stage.

Ternes said that his department and the university are discussing contracting with a private security company who would patrol the area and enforce all parking regulations.

Fargo has used private security to handle parking patrol at the airport for years.

HAYWARD CA Aug 7 2008 — As many as six armed robbers hit a Southland Mall jewelry store Monday afternoon, beating a security officer and escaping with an unspecified “high loss amount,” police said.
It was the latest black mark for the mall, which saw a fatal shooting May 18.
Witnesses said the bandits in Monday’s incident had been seen casing Highline Jewelers minutes before the robbery, which mall security staffers reported to police at 4:07 p.m., Lt. Christine Orrey said.
A mall security guard who radioed in the robbery was pistol-whipped and held at gunpoint by two men while the others grabbed jewelry, Orrey said.
The robbers ran out the mall’s east entrance, near a Sears store, and were last seen in separate getaway cars headed in opposite directions, Orrey said. A blue or gray compact car, possibly a Chrysler with paper plates, was last seen headed south on Calaroga Avenue; a white late model mid-or full-size sedan headed north toward Winton Avenue, the lieutenant said.
The guard was treated at the scene for minor injuries, Orrey said. None of the store’s employees was hurt.
Detectives are sifting through varying accounts of the incident, Orrey said.
“I don’t think they’re particularly sophisticated,” Orrey said of the robbers. “They’re bullies with a gun who outnumbered the employees. They’re just very brazen bullies.”
Orrey said witnesses provided the following descriptions:
All of the robbers were African-American men. Three were in their mid 20s.
One had dark-colored dreadlocks and was wearing a white sweater and tan pants.
Another wore a black hooded sweatshirt and jeans. A third was about 5-feet-10 with a medium build and goatee, and was wearing a black baseball cap, black-and-white round sunglasses, black hooded sweatshirt and dark blue jeans.
Another robber, in his late teens to early 20s, was 5-feet-4, with a thin build and wearing a black shoulder-length wig with dreadlocks, a brown-and-white striped sweat shirt and dark blue jeans.
The ages and descriptions of one or possibly two other robbers have not yet been established, Orrey said.
In the May 18 incident, an argument inside a shoe store at the mall led to the slaying of Lawrence Thomas, 29, of Oakland, outside the store.
Police in June identified Lumont Otis, 32, a San Francisco parolee with a lengthy criminal history, as a suspect.

http://www.privateofficer.com/ Authorities say that a prison guard has been arrested for allegedly helping an inmate escape from the Rockville Correctional Facility.
Officials say that their investigation found that correction officer Scott Spitler was involved in numerous incidents within the prison and could face charges of assisting a criminal, official misconduct, sexual misconduct and trafficking with an inmate.
He was arrested early today in connection with the escape of 29-year-old Sarah Pender of Nineveh.
Police and prison officers searched the area but Pender is still at large.

Officials say Spitler hid her in a prison vehicle and drove her outside the medium-security prison yesterday.
State corrections Commissioner Edwin Buss says an “intensive investigation” is under way to catch Pender and any others who may be involved in her escape.
Pender and Richard Hull Jr. of Noblesville were convicted of killing two former roommates in 2000. Pender received a 110-year sentence and Hull was sentenced to 75 years.
An all state bulletin has been issued for Pender and she is deemed a dangerous felon and police are actively tracking her.

On Saturday, August 2nd, Officer Mike Magadan was on patrol in the 700 block of West Mesquite Boulevard when he observed a security officer from the Oasis Casino running across West Mesquite Boulevard

The security officer yelled to Officer Magadan he was pursuing an adult male dressed in black clothing, who just robbed the casino of gaming chips.

As the security officer was talking to Magadan, Mesquite Dispatch alerted other officers after receiving a call from the Oasis security. Magadan observed the suspect running into the Casablanca parking lot where he was joined within seconds by Officer Craig Empey.

The suspect was taken into custody without further incident. Officials from the Oasis Casino were at the scene of the apprehension and positively identified the suspect.
The suspect was carrying a green shirt, which revealed a total of $1203 in gaming chips from the Oasis casino wrapped up inside the shirt.

The suspect was identified as 21-year-old Anthony D. Henderson of Colton, Calif. Henderson was taken into custody and booked on charges of robbery, burglary, and battery and later transported to the Clark County Detention Facility.

Chief Douglas Law commended Officers Magadan & Empey for the quick apprehension and arrest of the suspect. Magadan, who had previous experience as Oasis security, knew something was wrong when he observed the security officer running across the street.

Officer Magadan took immediate action by seeking out information and quickly apprehending the suspect. Chief Law also credited Mesquite Police dispatchers, Filiberto Ontiveros and Arnold Andrade for quickly dispatching the call and obtaining the necessary information from the Oasis security for officers to effect the arrest.

Two teens remained in Mansfield Jail this afternoon accused of burglarizing Morningside Middle School in Fort Worth.
Samuel Correa, 19, Jose Gallardo, 17, and a 13-year-old whose name is not being released because he is a juvenile, were arrested early Monday morning after officers responded to an alarm call at the school in the 2700 block of Mississippi Avenue, Fort Worth police said. The juvenile was released to his parents Monday afternoon, Fort Worth police Lt. Paul Henderson said.
The teens were discovered in the teacher’s lounge and fled on foot when a security officer entered the building.
Mr. Gallardo was soon found hiding under a table in the backyard of a home in the 1200 block of Roberts Drive. Mr. Correa and the juvenile were arrested at an abandoned house in the 1200 block of Colvin Avenue, police said.
Police found stolen property from the school, including USB drives, blank CDs, laptops and a Sony PlayStation in the teens’ backpacks, which were dropped during the chase.
Mr. Gallardo was accused of burglary, evading arrest and resisting arrest. He was being held in lieu of $5,000 bond. Mr. Correa and the juvenile were accused of burglary and evading arrest. Mr. Correa was being held in lieu of $4,000 bond.
Clint Bond, a Fort Worth ISD spokesman, said Mr. Gallardo and Mr. Correa were both former students of the school district. Mr. Correa withdrew in 2005 and Mr. Gallardo withdrew in 2006, he said. Because the 13-year-old has not been named, Mr. Bond could not say whether he was one of the district’s students.

DAYTON OH Aug 7 2008 — The 22-year-old sister and guardian of a 3-year-old Trotwood girl who died last month has been charged with murder and child endangering, the Montgomery County Prosecutor’s Office said Wednesday, Aug. 6.
Kimberly Cook-Terrill surrendered and was taken into custody by Trotwood police at 2:05 p.m., then taken to the Montgomery County Jail pending her initial court appearance today, Aug. 7.
She’s accused of causing Hope Cook’s death. The autopsy report is pending.
Hope died at Children’s Medical Center on July 20. Trotwood fire and rescue personnel took her there that evening after she apparently suffered seizures. Later that night, a neighbor called 911 and told a police dispatcher, “The little neighbor girl has had a seizure or something.”
The caller also said the child was breathing and lying on the floor.
“She was in the bathtub,” the caller said.
Greg Flannagan, spokesman for the prosecutor’s office, said the office, acting on the investigation by Trotwood police, approved the following charges:
• One count of murder.
• One count of endangering children, a third-degree felony.
• One count of endangering children, a first-degree misdemeanor.
• One count of endangering children, a second-degree felony.
According to Trotwood Sgt. Erik Wilson, Cook-Terrill turned herself in, asked for an attorney and declined to answer questions.
Cook-Terrill “maintains her innocence. She said she would never hurt her sister,” said James W. Thomas Jr., an attorney from Eaton who is the attorney for the family.
He said he has not been officially retained, but was the attorney Cook-Terrill asked for when she was with Trotwood police.
“My client’s confused,” Thomas said. “I haven’t seen any of the physical evidence. I don’t know what the medical records reveal.”
He said he received a phone call Wednesday from the location where Cook-Terrill was staying, informing him that police were out in front of the house with a warrant.
Cook-Terrill was the sister and legal guardian over Hope, he said.
The Preble County Department of Jobs & Family Services placed Hope with Cook-Terrill.
Hope’s biological father, Michael W. Cook, told the Dayton Daily News late last month, “I got in some trouble, then (we) lost custody.” He was released from prison July 2 after serving two years for attempted rape and gross sexual imposition.
“As far as I know, they were taking good care of her,” Cook said July 24 following Hope’s funeral. He could not be reached Wednesday night for comment.
According to Wilson, Montgomery County Children Services removed two other children from the mobile home at Voyager Mobile Home Park, off U.S. 35, where Hope lived. The children were placed in temporary homes, Wilson said, and they had signs of injuries. That investigation is continuing, he said

http://www.privateofficer.com/ A woman who allegedly abandoned her 3-year-old son in a Wal-Mart store with a note saying she could no longer care for him was arrested Monday in Indianapolis. Indianapolis Metropolitan Police spokesman Officer Paul Thompson said .
Julia Ornelas, 42, was arrested Monday evening on Indianapolis’ near south side by officers acting on a tip.
Ornelas, who was arrested on a warrant out of Clinton County for neglect of a dependent by abandonment, is expected to appear Tuesday in Clinton Superior Court for an initial hearing, according to a statement from the Frankfort Police Department. “We would like to get her here tonight so (Detective Maj. Jeff) Ward can interview her,” Frankfort Police Deputy Chief Randy Emery told The Times of Frankfort.
Authorities said Ornelas abandoned her son in a Wal-Mart in Frankfort on June 13 with a backpack full of toys, a bottle, diapers and a note written in Spanish explaining that his father had left her and she could no longer care for him.
Store employees brought the boy into their security office after they found him wandering around. A surveillance tape shows a woman arrive at the store in Frankfort, about 20 miles southeast of Lafayette, and enter with the toddler inside a shopping cart.
She did not buy anything and left six minutes later.
The boy is later seen struggling to keep up with the woman in at least one of the shots.
Thirty minutes later, an employee spotted him alone and called police.
