Phoenix AZ. NOV 4 2008
Phoenix police are searching for two men who held up a security guard delivering money to an ATM Monday.
The holdup happened outside an Arizona Federal Credit Union near Central and Baseline.
“One suspect had an assault rifle and one was armed with a handgun,” said Detective Cindy Scott. “One round was fired during the incident, but fortunately nobody was hurt.”
Scott said the armored truck was stopped at an outdoor ATM when a car pulled up and the two gunmen jumped out.
After taking an unknown amount of money, the robbers drove off in a white sedan. One of the armored truck guards, a retired police officer, tailed the men while he talked with a 911 dispatcher.
The men drove to a nearby K-Mart parking lot and abandoned the car.
Police searched the store and surrounding area without finding the men.

Inmate kept in isolation 9 mths without outside contact www.privateofficer.com

Inmate kept in isolation 9 mths without outside contact     www.privateofficer.com

Nashville TN NOV 4 2008
newschannel5.com
NewsChannel 5 investigates one inmate’s treatment inside the walls of a local prison.
He spent nine months in solitary confinement — without getting exercise, taking a bath or seeing a doctor.
Word of what happened in the prison leaked out a few months ago.
But, until now, we could only imagine how horrible it must have been. Our chief investigative reporter Phil Williams obtained video from inside the walls.
And you can decide for yourself: was it punishment — or was it torture?
It occurred at the Metro Nashville Detention Facility. Operated by the for-profit Corrections Corporation of America, it’s home to some 1,100 inmates.
The video shows one of those inmates, a mentally ill man emerging after nine straight months of solitary confinement — no longer able to speak a language anyone could understand.
“The man’s hair, his beard was matted up,” said Patrick Perry, the correctional officer who blew the whistle. “I had never seen an inmate live in those kinds of conditions.”
Originally convicted on drug charges, Frank Horton failed to check in with his parole officer. That’s how he ended up at the CCA facility in December 2005.
Horton’s mother couldn’t believe her ears when she heard about her son’s condition. “They could be talking about someone else, not my son,” Cytherea Braswell said.
His grandmother was equally shocked. “We never heard nothing else other than ‘Well, he’s in there and he’s doing OK,’” said Mary Braswell.
But one video clip — a month after his arrival — shows the first signs of trouble. After a fight with a then-cellmate, CCA reports show that the cellmate told officers that Horton was “hearing voices” and believed people were “trying to kill him.”
“An actual CCA intake form noted that Mr. Horton had had a history of psychological and mental illness and probable schizophrenia was noted on those forms,” said the family’s attorney, John Ray Clemmons of the law firm Blackburn & McCune.
So guards locked him up in solitary, and Horton became more and more difficult to control. Finally, as another video clip shows, he began to refuse to leave his cell at all.
Clemmons said, “Instead of treating Mr. Horton for the illness which was causing him to act in this manner, they punished him. They sprayed him with chemical agents. They put him in solitary and segregated confinement for extended periods of time with no medical treatment.”
Video clips — obtained by NewsChannel 5 Investigates — show Horton repeatedly being sprayed with inflammatory chemical agents.
Then, in May 2007, they stopped trying to force him out.
“Frank Horton went from being a beast to being, you know, barely able to speak to me,” the former correctional officer, Patrick Perry, testified in a videotaped court deposition.
Perry was CCA’s overnight supervisor at the facility. He says the inmate spiraled downward, as the days in his darkened, filthy cell turned into months.
Still, prison officials refused to forcibly remove him. Perry claimed it was because they feared too many incidents involving force could jeopardize their yearly bonuses.
“They would go to Frank’s door, look in on Frank, [ask] ‘Frank, you all right?’ As long as he was living and breathing in that cell, they kept moving.”
Horton’s grandmother, Mary Braswell, added, “I would call every so often and talk to the counselor. And she always said, ‘Well he’s doing OK.’”
She said that Horton’s family kept being told he had not authorized them to visit him.
Then, one night, Perry stopped by Horton’s cell. “I tried to converse with him, and he was speaking gibberish to me. And, at that time, that’s when I made up my mind to go the Health Department.”
Finally, Horton was brought out of solitary — after health officials intervened and after the family, who’d gotten wind of the situation, hired an attorney to go see him.
Clemmons recalled, “Mr. Horton was walking in circles around the cell, completely nude with nothing but what I would call an old barn quilt, just a thick blanket draped over him.”
CCA officials refused to answer questions about exactly what happened.
But get this: after Perry went outside the company to get help for Horton, CCA suspended him — eventually giving him a choice to accept a transfer or resign.
Perry resigned, and CCA paid him a severance to keep quiet.
“Frank’s situation was the tip of the iceberg,” Perry said, under oath. He explained that there were also other mentally ill inmates who, like Horton, were neglected.
Still, prison bosses pressured guards to keep secrets from the government monitor assigned to the facility. “Yeah, I made a mistake of talking to [Davidson County Sheriff's Department monitor] Jimmy Hale one time about something. I got my ass chewed for it royally,” Perry added.
Mary Braswell echoed, “To me — they didn’t want anybody in there to see.”
And Frank Horton’s family said they believe there’s a good reason CCA didn’t want anyone to see what become of their loved one.
“They was treating him worse than an animal because if it was an animal somebody would have went to his rescue,” Braswell said.
CCA has replaced the warden at that facility. But a spokesperson said that, because the company faces a lawsuit, they can’t comment on whether they think what happened to this inmate was right or wrong.
Horton’s lawyer got a court order to have him moved to a state prison hospital. He’s now on medication and, the family said, showing signs of recovery.

Fort Oglethorpe investigated for having on-duty sex www.privateofficer.com

Fort Oglethorpe investigated for having on-duty sex http://www.privateofficer.com

Fort Oglethorpe GA Nov 4 2008
from:galeo
A Fort Oglethorpe police officer has resigned after an investigation into allegations that he had sexual relations behind a business while in uniform.
A video recording from security cameras at Keith Heating and Air, Inc. in Walker County shows the officer around midday Saturday, pull up in his patrol car in uniform, meet with a woman, and begin kissing her. Later, the video shows her pulling up her pants and him fixing his uniform.
City Manager and City Attorney Ron Goulart declined to give the officer’s name until he could first notify his family, but said the sex was with a consenting adult. He said the officer resigned about 5 p.m. on Monday, Nov. 3, and no additional action would be taken.
“It’s just something we don’t condone,” he said. “It’s just conduct unbecoming an officer.”
Police Chief David Eubanks said he confronted the officer after a television news reporter from WTVC-9 brought him the surveillance tape, which someone had given them. He said the officer admitted to the allegations, apologized repeatedly, and asked to resign. His actions weren’t against the law, Eubanks said, but they clearly violated department policy.
“It was behind a business in the middle of the day in the middle of his shift (and outside his jurisdiction),” he said. “Certainly, that conduct was unacceptable and will not be tolerated under any circumstances or conditions.”
Goulart said the officer has been with the department for at least a few years, and has done a good job overall.
“We’ve got an excellent department and we’ll work through it,” he said. “You’re going to have issues from time to time.”
Goulart said the police department was forced to investigate and act on the matter quickly when the news station produced the evidence with plans to air the story the same evening. He said that was the first he had known about the matter.
Eubanks said it’s possible the officer won’t be replaced because of a tight budget, but he expects no hardships from losing a position.
“We’re probably overstaffed in a couple of areas anyway,” he said.

Buffalo NY Nov 4 2008
The call came out early in the third quarter Sunday to investigate numerous complaints of a commotion in a ladies’ restroom across from Section 336 in Ralph Wilson Stadium.
It didn’t take security officers long to figure out the cause of what police later called a “public disturbance” in the restroom.
A woman, law enforcement officials said Monday, was having sex with her boyfriend in a bathroom stall.
The couple was arrested, two of 37 people arrested at the stadium by Orchard Park police and Erie County sheriff’s deputies before, during and after Sunday’s Bills-Jets game.
Police charged Alicia A. Venneman, 29, of Northville, in the southern Adirondacks, with disorderly conduct.
They also charged a man whom police identified as her boyfriend, Jeramy H. Kemper, 31, of Mayfield, with trespassing and resisting arrest.
“This was inappropriate behavior in public,” Scott Berchtold, Bills vice president of communications, said Monday. “Our security staff reacted accordingly, and law enforcement officials were called in to handle the situation.”
In November 1998, a couple was charged with public lewdness after being caught having sex in the upper-level stands during a Bills game.
After being convicted in a nonjury trial, each of them was fined $500 and ordered to perform 100 hours of community service.
Sunday, law enforcement officials logged more than the average number of arrests at a Bills game, making 37 arrests, 32 by Orchard Park police and five by the Erie County sheriffs.
Authorities made 16 arrests at the San Diego game two weeks earlier, 39 at the Oakland game Sept. 21 and 28 at the Seattle game Sept. 7.
Charged with disorderly conduct Sunday were Robert J. Phillips, 28, of Ontario; Mark J. Webster, 22, of Hamilton, Ont.; Eric M. Sholtz, 33, of the City of Tonawanda; John A. Betzig, 41, of Depew; and Alicia J. Scholtz, 31, and Todd A. Scholtz, 32, both of North Tonawanda.
Criminal trespass charges were filed against Wesley Couto, 27, of Cambridge, Ont.; Michael B. Barlow, 24, of Elmira, Ont.; Joshua F. Greenwalt, 18, of Lockport; Timothy Raywood, 21, of New Jersey; Peter J. Cummings, 30, of Atlanta; Daniel J. Cummings, 23, of Williamsville; Steven W. Wilson, 48, of Hamilton, Ont.; Scott K. Miller, 25, of Toronto; Heather R. Barniac, 18, of Greenwood; and Shawne E. Porter, 20, of Hornell.
Seven people were charged with unlawful possession of alcohol: Michael R. Ferguson and Mark D. Ferguson, both 19, of Ancaster, Ont.; Michael A. Fallis, 20, of Hamilton, Ont.; Brian R. Lux, 18, of West Seneca; Michael Multer, also known as Ryan Multer, 19, of Penn Yan; Travis S. Duchmann, 18, of Hamburg; and Matthew J. Bratcher, 19, of Hamburg.
Facing charges of obstructing governmental administration are Kevin F. Dawson, 22, of Caledonia, Ont.; and Jason J. Virtue, 36, and Mark A. Virtue, 34, both of Brantford, Ont.
Orchard Park police also arrested Brandon P. Ferraro, 21, of Caledonia, Ont., on charges of assault and robbery; James C. Allen, 21, of Buffalo, marijuana possession; Mark J. Boyd, 45, of Hempstead, harassment and resisting arrest; and Deborah A. Wales, 46, of Arizona, DWI.
Sheriff’s deputies arrested five, including disorderly conduct charges against three Ontario residents: Ivan Mitar, 24; Nicholas Fox, 25; and Andrew MaCartney, 25. They charged Keenan VanRooyen, 16, of Ontario, with underage drinking; and Duane Gworek, 47, of North Tonawanda, with DWI.

Police make large drug bust across from PD www.privateofficer.com

Police make large drug bust across from PD http://www.privateofficer.com

Pearl River LA Nov 4 2008
nola.com

A Pearl River couple who lived right across the street from the Police Department – on Church Street no less recently were arrested for allegedly growing and selling marijuana.
Police say they are looking into whether the two possibly sold the drugs, alongside shaved ice and syrup, at their local summer snowball shop.
Jeremy J. Miller, 25, and his wife, Janine Wilholt, 25, were arrested Saturday, accused of growing and stashing about $20,000 worth of marijuana at their home at 64581 Church St., across the street from both Pearl River Town hall and police department.
In addition to finding nine potted, marijuana plants in the home, police said the house contained a 20-pound bag of marijuana, scales, other smaller bags filled with drugs, ready for distribution, and $1,400 in cash.
The Millers are facing charges of possession of marijuana and paraphernalia, and manufacturing and distribution of marijuana.
They could face a five to 30 years in prison if convicted of the charges.
Miller’s mother Jonette, 52, who lives at the home, was booked only with simple possession of marijuana because she wasn’t in the house when officers began their search, police said. She faces up to six months in the parish jail and a $5,000 fine if convicted.
Jeremy Miller also has been booked with simple kidnapping and simple battery. He could face up to five years in prison on the kidnapping charge.
The marijuana was allegedly discovered on Saturday by Charter Communication workers who were at the Millers’ home to run a cable. The three workers found a bag of marijuana, and one of them immediately walked across the street and handed it to police, authorities said.
When Jeremy Miller realized the marijuana was missing, he allegedly became hostile and forced the remaining two utility workers to remain in his home, saying he would not release them until he had his marijuana back, police said.
Police said they quickly responded to the scene and arrested Miller, who was not armed and had no guns in his house.
After the incident, the two workers allegedly told police that they had feared for their lives.
