www.privateofficer.com A Columbia man was arrested early Sunday after allegedly brandishing a handgun during an argument with a co-worker at Panera Bread bakery at Columbia Mall.
Police and mall security responded to a complaint that a man brandished a firearm inside the mall and conducted an investigation into the incident.
Police charged David Perry, 24, with suspicion of second-degree assault, unlawful use of a weapon and armed criminal action. He remained in custody Monday at the Boone County Jail pending a $40,000 bond.
Officers were dispatched at about 5:45 a.m. to the parking lot of the mall, where two employees of Panera Bread were involved in a confrontation, according to a news release from the Columbia Police Department.
According to the report, Perry pulled a handgun from the waist of his paints, cocked the gun and pointed it at the victim, a 35-year-old Columbia man, the news release said. The victim noticed the gun had malfunctioned and took it from the suspect, the news release said.
He then went inside the business with the gun and contacted mall security who notified city police and responded to the business where they confronted the men.
Perry was arrested on scene, and the gun was recovered according to the press release.

ETSU student carjacked on campus www.privateofficer.com

ETSU student carjacked on campus http://www.privateofficer.com

JOHNSON CITY TN NOV 11 2008 — An East Tennessee State University student was carjacked on campus Monday afternoon, according to university officials.
Jack Cotrel, ETSU’s director of public safety, said a female student pulled into Parking Lot 15 about 3:44 p.m. and noticed in her car’s rearview mirror that a male was approaching her car. The suspect showed the student a gun in his jacket but never actually pointed it at her, Cotrel said.
Cotrel said the student struggled briefly with the man, but he managed to take the car and flee.
The student was not hurt. At 4:30 p.m. she was speaking with investigators at ETSU’s Public Safety offices.
The Johnson City Police Department was notified immediately of the carjacking, and authorities were pursuing the suspect on Interstate 26. The suspect reportedly passed into North Carolina.
Unicoi County Sheriff Kent Harris said his department did not get the word about the fleeing carjacker until the man was already in North Carolina.
By 5:15 p.m. Carter County Sheriff Chris Mathes called to say the vehicle was out of sight, Harris said.
“None of my officers ever saw it,” he said about 6:30 p.m. “We’re still looking for the vehicle. From what I’ve been told by officials, evidently they lost sight of (the car) around Mars Hill, (N.C.).”
Harris said all of his deputies are aware of the details about the vehicle. One officer was stationed in the late afternoon at the state line on the Old Asheville Highway and was able to see Interstate 26 from that spot. Other Unicoi County officers helped worked the case.

Secret Service police officer arrested in prostitution sting www.privateofficer.com

Secret Service police officer arrested in prostitution sting    www.privateofficer.com

Washington, D.C. (WUSA) NOV 11 2008 — A Secret Service officer was arrested early Saturday during a prostitution sting conducted by D.C. police in Northwest.
Inspector Brian Bray, commander of Metropolitan Police Department’s Narcotics and Special Investigations Division (NSID), says his squad was conducting a prostitution sting in the area of 11th and K Sts NW around 12:50 a.m. when a marked Secret Service Uniformed Division patrol car stopped to speak with an undercover female officer who was posing as a prostitute.
The patrol car was driven by a Uniformed Division sergeant who was in uniform. Insp. Bray said the NSID officers assumed he was going to tell the undercover female officer to leave the area.
But the sergeant allegedly engaged the female officer in dialog, mentioned how attractive she was, and inquired about what sex acts she would perform. They agreed on a price of $20 and he drove around the corner to meet with her.
That is when he was arrested by D.C. police officers. The sergeant was taken to the 1st District police station where he was processed and charged with solicitation for the purpose of prostitution. Insp. Bray says that is a misdemeanor.
Insp. Bray added that this area is frequented by prostitutes. D.C. police have been successful making arrests in the neighborhood and that is one reason why they were working it early Saturday morning.
Darrin Blackford, Secret Service spokesman, said the incident is being investigated by the Secret Service Inspection Division which is the agency’s internal affairs division.
The majority of the 1,200 Uniformed Division officers are assigned to guard the White House complex. But Uniformed Division officers are also assigned to the vice president’s residence and the Foreign Missions Branch, which protects embassies and missions in the Washington area.
Blackford says the officer, whose name has not yet been released, has been placed on administrative leave pending the outcome of the investigation.

A Norton man is accused of leading police on a chase while drunk from Southeastern Regional Vocational Technical High School into Norton early Saturday.
Devan J. Dewever, 19, of Brian Road, Norton, was charged with operating while under the influence, second offense, reckless operation, assault and battery with a dangerous weapon, assault and battery on a police officer and four counts of leaving the scene of an accident.
The arrest came after police were called to the high school by the security guard, who said a man pulled up next to his vehicle, drunk, got out and began to pound on the roof of his car with his fist, Deputy Police Chief Allen Krajcik said.
The guard backed up his car and the suspect began to chase him through the parking lot before leaving, the deputy said.
The suspect then returned and started to chase the security officer again, Krajcik said.
Police were enroute at the time as he drove west on Route 106, and tried to stop him, he said.
“He turned onto Prospect street, heading toward Norton, and on the way he was wiping out mailboxes and speed limit signs,” Krajcik said.
Dewever was eventually stopped by Norton police and Easton Officer Keith Boone arrested him.
While in the booking room at Easton police station, Dewever was swearing at police and being disruptive, Krajcik said.
At one point, Dewever elbowed Boone in the chest, he said.

Police supervisor accused of sexual assault of recruit www.privateofficer.com

Police supervisor accused of sexual assault of recruit http://www.privateofficer.com

Atlanta GA. NOV 11 2008(AJC)
A veteran Clayton County police officer was demoted but allowed to keep his job after admitting to kissing, fondling and sexually harassing a recruit.
Henry Derbyshire, a 28-year veteran of the Clayton County Police Department, was demoted from sergeant to patrol officer after investigators found he violated the county’s sexual harassment policy.
“He lost $15,000 in pay and was demoted to fleet maintenance,” police Chief Jeffrey Turner said. “We took action and in my opinion, it was appropriate action. She wanted him terminated, but she doesn’t make those decisions.”
But now the County Commission wants to know why Derbyshire still has a job and was not prosecuted.
County Commission Chairman Eldrin Bell asked the county attorney to look into the case after the victim complained to him last week.
“I have questions about this entire matter,” Bell said Monday. “The credibility of our Police Department is of paramount concern to this government. I am outraged.”
Concerns about sexual harassment arose in August when a 36-year-old female recruit complained about Derbyshire, then a recruiter and internal affairs investigator. The recruit passed the police qualifications test but never returned to complete the hiring process.
The Atlanta Journal-Constitution received the investigation and Derbyshire’s personnel file through an Open Records Act request.
According to the woman’s statement, Derbyshire —- who had the job of investigating the department’s sexual harassment complaints —- told the recruit he could get rid of any complaint she made.
Under Georgia law, Derbyshire’s actions would be considered sexual battery, said Shawn Paul, president and chief executive officer of the Georgia Network to End Sexual Assault.
“Any person commits sexual battery when he or she makes intentional unwanted physical contact with intimate parts of the body,” Paul said.
She is concerned that the police department is not taking more action, Paul said.
“I believe we have a right to be treated with dignity and with respect from the people who are charged with protecting us,” Paul said. “These allegations are troubling to me.”
Turner said he launched an internal investigation after receiving the complaint. He did not initiate a criminal investigation because the woman did not want to prosecute, Turner said.
The case would be thrown out in court if the woman declined to testify, Turner said.
Internal affairs investigators found Derbyshire guilty of conduct unbecoming of a county employee. Turner said he decided against terminating the officer based on his record and the lack of evidence of sexual battery.
“This is a he-said-she-said deal. The officer said it was a mutual situation,” Turner said. “He has an exemplary record of 28 years of service. This man has a year and a half before he can retire. I’m not going to ruin his career.”
Derbyshire’s personnel file shows no previous sexual harassment complaints. The only reprimands he received were for vehicle accidents and yelling at a fellow officer who gave his now ex-wife a speeding ticket.
Under Clayton County policy, employees found guilty of sexual harassment can receive a written reprimand up to termination.
Derbyshire, who lives in Peachtree City, did not return phone calls Monday. The woman declined to comment, other than her statement to police.
The woman told police she has spoken with an attorney, but has not decided to take any action until she sees what the County Commission does.
The County Commission is now setting up a personnel review committee to investigate this case and other sexual harassment concerns.
Commissioners Virginia Burton Gray and Wole Ralph said they both were concerned about the incident and needed more information before deciding if additional action should be taken.

Murder Suspect Captured After Shoplifting Incident www.privateofficer.com

Murder Suspect Captured After Shoplifting Incident http://www.privateofficer.com

Tuscaloosa AL NOV 11 2008

A man accused of fatally shooting an acquaintance in Waldorf was arrested last week in Alabama after authorities there had brought him in for questioning in a shoplifting case, police said.
James C. Ford Jr., 20, had eluded authorities for nearly three months after police issued an arrest warrant charging him with murder in the August shooting death of Joseph R. Burgess, 21, of Waldorf. On Tuesday, Tuscaloosa police took Ford and another man into custody in connection with allegations of shoplifting at a department store.
Police said the other man, a friend of Ford’s, gave investigators Ford’s name after Ford tried twice to give them fakes. They plugged Ford’s name into a computer search engine, which led them to a listing for him in the “Most Wanted” section of the Charles County Sheriff’s Office Web site.
“They originally were going to charge him with giving false names to a law enforcement officer,” said Capt. Greg Kosloff, a Tuscaloosa police spokesman. “When he waived extradition, we waived our charges.”
It was not clear whether the friend knew Ford was wanted for murder. The two were questioned separately about the shoplifting, Kosloff said. Police did not release the other man’s name because he had not been charged in that case
Ford had been wanted since Aug. 11, when police accused him of shooting Burgess and pistol-whipping another man about 11 p.m. that day. The group had had a dispute about a girl earlier in the day, police said. Officers declined to provide details about what sparked the dispute.
Adrian Davis, Ford’s brother-in-law, disputed parts of the police account. He said that several witnesses are not talking to police but that they have told others that three men, including Burgess, jumped Ford. He said Ford did not pistol-whip a man, as police have said, but swung at him defensively. And he said Ford’s gun was in Burgess’s hand when it discharged during the struggle.
“No one is actually sure where the gun came from, but the gun actually ended up in the hand of the boy who was shot,” Davis said. “The gun was in his hand when they fell.”
Davis said he hopes witnesses will share their information with police instead of with their friends in Waldorf.
“I would like to try to get them to say something, to speak up,” he said. “They’re talking around their neighborhood, but they’re not saying anything to the police.”
Late last week, Ford remained jailed in Tuscaloosa. It was not clear when he would be moved to Charles County, said Diane Richardson, a sheriff’s office spokeswoman.
Ford also had an outstanding arrest warrant stemming from an incident in July in which he is suspected of firing a handgun in a Hughesville restaurant and in its parking lot, police have said.
He also had an outstanding bench warrant in Charles for failing to appear at a court hearing in May on drug charges, court records show.
