One of the most useful and probably the most effective tool that I’ve used in the security profession has not been my gun or handcuffs or pepper spray, but my pen! Many years ago, I designed a trespass warning system and guidelines that our officers used in ten states to control illegal drug use, loitering, vandalism, thefts, gambling, guns and violence in federal housing complexes as well as apartment complexes, clubs, shopping malls and many other businesses.

The general public is of the mindset that all of these businesses, especially those who heavily advertise for customers such as a department store, restaurant, amusement park etc. are public property and that no one has a right to tell them to leave.R
easonable people of course know that this is not true.
Although these facilities and businesses are open to the general public and they are allowed access and encouraged to come and shop, party, play and relax, they are all private property and under the direct control of the property owner, renter or their agents including security personnel.
While the public is acting appropriately and using the facilities and properties as they are intended to be used and not being disorderly, drunk, committing crimes or causing a ruckus, all is well. However, the minute that any of those things change, the person can immediately be trespassed off the property for a certain length of time should the situation warrant it.
Anyone who has damaged the property, caused a serious disturbance, been prosecuted for a crime, injured a staff member, patron or security officer should be trespassed for an extensive period of time.
Shoplifters, intoxicated persons, loiters, or those involved in minor offenses can also be trespassed at the property agent’s discretion.
ISSUANCE OF TRESPASS
Trespass warnings can be issued verbally or in writing and we always recommend the latter. The key to a good prosecution or defense is a paper trail.
We have designed a Trespass Warning in a format similar to a traffic citation.
There are blocks for trespassers name, address, date of birth, social security number, description and signature.
There is also room to include details of why the person has been trespassed from the property.
We explain the trespass warning to the person being trespassed and provide them with a copy with the reminder that they will be arrested should they return to the property.
With each trespass warning, comes a digital photo of the person which is then stored in a trespass warning computer file as well as a 3 ring binder which is issued to our officers on patrol.
Some states require that the trespass warning be issued by the local police department to be an “official” trespass notice.
So once you have decided to trespass someone from the property, detain that person until police arrive and let them issue the warning as required by their protocols. This is not required of law but to be cooperative with your local police, let the officers follow their department policy.
SIGNS
Some states require signage be posted before any trepass warning or arrest can be made. We strogly suggest that No Trespass Signs be posted at each entrance to the property which clearly state that this is “Private Property” and all violators are subject to arrest.
While signage such as this is not always advisable to customer friendly in common areas such as malls, arcades, nightclubs, etc, keep in mind that it can still be spelled out in a classy fashion by using stencil or lettering on your door glass in a visable location.
This type of signage should also be used for No Skateboarding, no Loitering, No Dumping and other property policy and regulations so that the proiperty owner and agents know that the message has been properly, legally and claerly conveyed and now violators can be dealt with accordingly.
TRESPASS ARREST
Once a person has been issued a verbal or written trespass warning, they are subject to arrest should they return to the property during the period that the warning is valid.
At the time of trespass and if your state statures and employer allows, you may detain or arrest the subject for criminal trespass without further warning.
Should you be called into court on this trespassing arrest, always bring the original trespass warning that was issued, the digital photo that was taken and any incident that may have been written by your department and the police agency regarding the trespass warning.
This will provide solid evidence that the person had been notified not to return to the property and that they were fully aware of the consequences should they re-enter the property.

On this day, when we give thanks for the people we love, it’s impossible to know how long their lives will last.
For Sherita Washington and her husband, it was not very long.
Last year, on the day after Thanksgiving, a gunman killed her husband, Bobby, for seemingly no reason.
This year, his widow says there is still plenty to be grateful for.
The murder took place downtown where Bobby Washington was working as the doorman for a party in a penthouse.
The timing sent shock waves throughout the entire community.
But the community response is what they are grateful for.
Like any family, Sherita Washington and her sister want Thanksgiving dinner to be perfect.
But as she gets ready for this Thanksgiving, Sherita can’t help but remember the last one, the last she spent with her husband of eight years.
“My husband, he just wanted to do dinner at home, with just the family, just me and the children,” she said.
The very next day, less than two hours after starting a security job in downtown Dallas, Bobby Washington was dead, shot down by a stranger whose motive remains unknown.
The murder left Sherita raising four children alone, a Thanksgiving tragedy so profound, that when News 8 viewers saw the family facing a bleak Christmas, they got so many gifts, they ended up giving some away.
“I was able to help out a family that didn’t have anything. She had four kids of her own,” said Sherita.
A year later, these kids all say they remember their dad.
But at this age, they don’t really understand death.
“They say ‘call him’… that’s the hardest for me and I go take a shower. I take care of my tears in the shower, so they won’t see me. I try to be strong for them a lot,” said Sherita.
With support from family and new-found friends, she’s trying to move on, thankful for the man she had, and the lives still left to live.
“I look at it as God just sent an angel down eight and a half years to give me four children and damn, he’s gone,” Sherita added.
But in these five faces, his love, and his legacy live on.

Family of Wal-Mart employee shot to death awarded $35 million http://www.privateofficer.com
PHOENIX AZ Nov 28 2008 (AP) – The family of an Arizona Wal-Mart employee shot to death by a mental patient has been awarded $36 million by a jury.
A Maricopa County Superior Court jury on Wednesday awarded the damages to the widow, two children and parents of Patrick Graham. He was fatally shot in Peoria in 2005 by Ed Liu, a paranoid schizophrenic under the treatment of ValueOptions Inc.
The jury found the Virginia-based company 90% at fault in Graham’s death and ordered it to split the payment with its Arizona subsidiary.
An attorney for the Grahams accused ValueOptions of negligence for not following its own guidelines in caring for Liu. Liu had been off his medications for nearly eight months at the time of the shooting.

- Bridgeport police say that they have captured the person responsible for shooting a security officer at an area nightclub in September.
The city teenager is now charged with shooting the security bouncer who refused to let him enter a local club.
According to detectives, they have been looking for eighteen-year-old Kevin Wilson who they believe is responsible for pulling a handgun and shooting the bouncer when he was refused entry into the ACES Club because he was carrying alcohol.
Wilson is charged with attempted murder, first-degree assault and carrying a pistol without a permit. He was arrested Wednesday on a warrant stemming from a Sept. 27 incident.
Police say Wilson fought with a 25-year-old bouncer at the ACES Club and when he was being restrained from entering pulled a handgun and shot the security man in the arm, leg, and chest, but he survived his wounds.
A Bridgeport judge ordered Wilson held on $250,000 and continued the case to Dec. 9. Information was not immediately available Thursday on whether he had an attorney.

A shoplifting suspect who jumped off the second story of a parking garage to escape police Sunday died yesterday, authorities said.
Chula Vista police said officers had chased Manuel Bareno, 26, of Chula Vista into the three-story garage on F Street. They were about 15 feet away, yelling at him to stop, when he looked back at them and jumped over the side.
He hit the ground and suffered a broken leg and major head injuries. He was taken to UCSD Medical Center, where he died about 12:30 p.m. yesterday, the Medical Examiner’s Office said.
Police first received a call involving Bareno, a parolee, about 9:20 a.m. He allegedly battered his grandmother on Roosevelt Street, police Lt. Scott Arsenault said.
Officers were at the grandmother’s house when, 10 minutes later, employees at La Bella’s Pizza Garden on Third Avenue reported that a man had stolen two six-packs of beer and told employees he had a knife. He was seen running toward Memorial Park, and officers saw him run from there to the garage.
Arsenault said officers were told that just before Bareno went to La Bella’s, he tore up the coffee shop next door by throwing things to the floor.

Security turns tables on would-be robbers http://www.privateofficer.com
NORTH TOLEDO OH NOV 28 2008 (WTOL) – They came in with guns terrorizing shoppers, but left when the tables were turned on them. Toledo police say a security guard confronted the two gunman at the 7-11 on LaGrange early Wednesday morning, November 26.
They rushed in with guns out and masks covering their faces. From the surveillance video, you can see the 2 a.m. customers at this 7-11 obeyed and got down on the ground.
Before the robbers got their hands on the register, someone else appeared with a badge and a gun. “They walked around the store. They were there. They made their presence known,” says Kenneth Lipkins.
Lipkins worked at the 7-11 for eight years and felt safe with security guards this time of year. “Especially during the holiday time,” he says, “because people get really greedy during this time and desperate.”
He says the robbery proves they work since the robbers took off with no one hurt and no cash in hand. with the high number of armed robberies, he wonders why more stores don’t use them.
“If you see a live officer in uniform, it’s like having an ace in your hand,” says Kabil Shaheen of Kabil’s Quick Stop. Shaheen takes security seriously with cameras, an alarm on his register and bullet-proof glass. Though he says none of it beats live security.
He says 95% of the stores don’t use security guards since they cost $25 dollars an hour. “You have to be making enough money to be able to afford it, really.”
He hopes this success will prompt changes, even causing the city to offer up its own officers for a flat yearly fee to protect those caught in crimes like this.

Wal-Mart employee trampled to death http://www.privateofficer.com
Nassau County NY Nov 28 2008 – A worker was killed in the crush Friday after a throng of shoppers eager for post-Thanksgiving bargains burst through the doors at a suburban Wal-Mart, authorities said.
At least four other people were injured, and the store in Valley Stream on Long Island was closed.Wal-Mart Stores Inc. in Bentonville, Ark., called the incident a “tragic situation” and said the employee came from a temporary agency and was doing maintenance work at the store.
“He was bum-rushed by 200 people,” co-worker Jimmy Overby, 43, told the Daily News.
“They took the doors off the hinges. He was trampled and killed in front of me. They took me down too. … I literally had to fight people off my back.”Nassau County police said the 34-year-old worker was taken to a hospital where he was pronounced dead at about 6 a.m. The man’s name was not released and the cause of death was not immediately known.A police statement said shortly after the store’s 5 a.m. opening time, shoppers “physically broke down the doors, knocking (the worker) to the ground.”
A metal portion of the door was crumpled like an accordion.Shoppers around the country lined up early outside stores in the annual bargain hunting ritual known as Black Friday. Many stores open early and stay open late, and some of the most dramatic bargains are available in limited quantities.Among the bargains offered by Wal-Mart for Friday were Samsung 50-inch high definition Plasma TVs for less than $800.Witnesses told the Daily News that before the store was closed, eager shoppers streamed past emergency crews as they worked furiously to save the worker’s life.”They were working on him, but you could see he was dead,” said Halcyon Alexander, 29. “People were still coming through.”
A 28-year-old pregnant woman was taken to a hospital for observation, and she and the unborn baby were both reported to be OK, said Sgt. Anthony Repalone, a Nassau County police spokesman. Four or five other people suffered minor injuries, he said.Ellen Davis, a spokeswoman at National Retail Federation, said the group knew of no other incident where a retail employee has died working on the day after Thanksgiving.Wal-Mart is working closely with police, company spokesman Dan Fogleman said.
“The safety and security of our customers and associates is our top priority,” Fogleman said. “Our thoughts and prayers are with them and their families at this difficult time.”
