Colt MFG. Guard charged with hate crime http://www.privateofficer.com

WEST HARTFORD CT Feb 4 2009 – – Police have charged a former armed security officer at Colt Manufacturing with a hate crime after confirming the company’s suspicions that the guard had scrawled swastikas on office desks and also attempted to steal a rifle and a laptop computer.
One employee had briefly resigned in fear before the suspect, Edward Moreno, was arrested in December and fired.
She later returned to work. Company officials secretly installed a surveillance camera to try to identify the vandal and thief, according to Det. Paul Roy’s warrant affidavit.
Swastikas were drawn on the desks of several minority employees at night or on the weekend and covered with papers so the graffiti could be easily discovered when the workers returned to their desks, the affidavit states.
Much of the vandalism was done in early November.Moreno, 41, of East Hartford, was charged Dec. 15 after a month-long investigation with intimidation due to bias and third-degree larceny, both felonies, and criminal mischief, a misdemeanor.
At a court appearance Jan. 26, Moreno applied for accelerated rehabilitation, a form of pre-trial probation. If he’s granted the program and stays out of trouble the arrest would be wiped from his record. He is due back in Superior Court in Hartford on March 9 to learn whether a judge will grant the request. In these cases, victims and others who are affected by the alleged behavior can indicate whether they agree or disagree with the request.
Colt maintains a large gun manufacturing plant at 545 New Park Avenue.
Company officials first reported incidents of vandalism to West Hartford police in August, but no suspects were identified.
In November, Moreno was caught on video tape going in and of the room that contained the computer that was later found in a maintenance closet.
Under questioning from Roy, Moreno admitted to concealing the laptop, a rifle, and several rifle parts, and also admitted that he was responsible for the racist graffiti, the affidavit states.
The detective reported that Moreno said he felt underappreciated and had stress in his home life.

Sonora CA
Police arrested a 21-year-old homeless man Saturday in Sonora who, they said, punched and kicked store security guards who tried to stop him from leaving a store with a pilfered bottle of liquor.
Sonora police went to the Pak ‘n Save at 1291 Sanguinetti Road about 8:20 p.m. after two security guards tried to stop the man, later identified as Alex Simmons, police said. The security guards said they had seen Simmons hide the bottle in his clothing and then leave the store.
They told police they tried to stop Simmons outside the store, but he kicked one guard and punched the other one. He tried to flee but the two guards said they tackled him in the parking lot, police said. Simmons and the guards narrowly avoided being hit by a car, police said, and Simmons was taken into custody.
He was taken to Tuolumne County Jail where he was held on suspicion of armed robbery. Simmons remained in custody Monday night.
CASCADE TOWNSHIP, Mich. Four people are in jail after an armed robbery at a gas station in Cascade Township. The Kent County Sheriff’s department got a 911 call just before midnight from the Mobil gas station in the 4900 block of Town Center Court.
Workers there reported that three people walked in and demanded cash. One of the suspects had a knife. The three people stole the store’s safe and a carton of cigarettes.
A short time later, security at Ford International Airport called deputies with a report of a suspicious subject in traffic on Patterson and 52nd Street. Deputies went to the location, searched the person in the car and found the carton of missing cigarettes. Additional information led to the arrest of two men and a woman who were also involved.
The safe was found intact a short distance away from the gas station.
METHUEN MA A man concealed two pairs of jeans under his coat at the Old Navy store at The Loop and tried to walk out the door. He never made it, police said.
A store security officer stopped the man, later identified as Jose Penalo, 18, of 132 Brookfield St., Lawrence, and escorted him to the office to await police.
Penalo gave store officials and police a false name but later admitted his real name at the police station as he was being booked, police said.
Penalo was charged with shoplifting.
Newman GA.
A Sharpsburg man was charged with shoplifting after cops caught him with his pants packed at Newnan’s Target store off Newnan Crossing Bypass.
According to a Jan. 24 report by officer James Beneke, Target security personnel reported they had stopped a suspected shoplifter. Beneke went to Target and met the suspect, later identified as Samuel Nicholas Jones.
A Target official told officer Beneke she had watched Jones visit the electronics department and pick up two video games. She was still watching when Jones placed the items in his pants.
Target officials had already reclaimed the games from Jones’ jeans when the law arrived. When asked for identification, Jones said he had none. Beneke escorted Jones to the police cruiser and began a search for weapons or other suspicious items.
At that point, Jones said he wanted to come clean and admitted he actually did have identification. It was in his wallet. Which was in his underwear.
After the wallet was carefully removed from its resting place, Jones’ identity was confirmed and he was booked for shoplifting, resisting arrest and interfering with an officer.

Fort Lewis soldiers arrested for robberies www.privateofficer.com

Fort Lewis soldiers arrested for robberies http://www.privateofficer.com

Seattle WA. Feb 4 2009
Two Fort Lewis soldiers were arrested Tuesday on suspicion of robbing three University of Washington students last month.
On Jan. 17, two victims were pistol-whipped and robbed in the 1600 block of Northeast 47th Street. A third was threatened with a gun, Seattle police said.
Seattle robbery detectives, working with the Army’s Criminal Investigations Division, discovered evidence pointing to the two soldiers.
The suspects, a 19-year-old from Atlanta, Ga., and a 20-year-old from Nashville, Tenn., were arrested about noon and booked into the King County Jail for investigation of robbery and assault, police said.
It was unclear whether police think they were involved in other crimes in the area.
Last week, an e-mail alert warned University of Washington students of “a rash of recent robbery incidents in the area north of the University of Washington’s Seattle campus.
The alert said UW police were coordinating with Seattle police.
In a recent report, police referred to The Ave – as “the high crime, high narcotic area of the University District.”
“Additional officers have been added by the University of Washington to patrol the area,” according to the e-mail.
“The Seattle Police Department has shifted both North Precinct resources as well as citywide resources to the area. This upsurge of violent activity is unacceptable.”

Woman claims San Antonio mall security discriminated www.privateofficer.com

Woman claims San Antonio mall security discriminated http://www.privateofficer.com

San Antonio TX Feb 4 2009
A Texas woman intends to prove that security officers at a San Antonio shopping mall unfairly targeted her and her girlfriend when they were arrested in December on trespassing and other charges.
Jessica Garcia, 22, said a Bexar County sheriff’s deputy and an employee from a private security company began harassing her and her 22-year-old girlfriend because her girlfriend gave her a kiss on the cheek while they were sitting on a bench inside the Rolling Oaks Mall in northeast San Antonio.
Mall officials said the women were acting inappropriately and were told to leave because they were not complying with the shopping center’s code of conduct.
Danielle Pardue, the mall’s marketing director, denies the women’s claims of discrimination and said security officers would evict anyone found kissing in the mall, regardless of sexual orientation.
“If our security officer feels that is disruptive to our shoppers and our business, then they have that authority to make that determination,” she said. “It’s their responsibility to make sure our shopping place is an enjoyable shopping place for everyone to be.”
She said the women were not arrested because they were kissing but because they had re-entered the mall after being told to leave.
Garcia had been due to appear in court today but her lawyer had to postpone until later this month.
She said the officers intentionally harassed the couple, accusing them of kissing and having “swapped spit.”
She said that after her girlfriend gave her a kiss on the cheek, the officers approached them and warned them to stop.
“He said: “This is a family mall, y’all can’t do this,’” she said. “We said, “Do what?” He said, “Y’all kissed, and if y’all do it again I’m going to write you a citation or I’m going to kick y’all out.””
Pardue initially said it was the kissing that gained the officers’ attention, but she later clarified that the officers approached the women to tell them to sit properly on the bench.
She said one of the women was sitting on the other’s lap — a claim Garcia disputes. Garcia said her girlfriend had the lower portion of her leg around hers, from the knee down. She said neither was sitting on top of the other.
“The officers passed people who were kissing and they didn’t tell them anything, but they came to us,” Garcia said. “We didn’t even kiss. All she did is she kissed me on my cheek. There’s no other way to explain it. They discriminated against us.”
Pardue said the women complied briefly with the officer’s request, but once the officers began walking away, they continued to engage in an “activity that was not appropriate for the public.”
She said that at that point, the officers told the women to leave.
Garcia said she and her girlfriend walked out of the mall, but re-entered through another entrance in order to take a shortcut to their car, which was parked on the other side.
Pardue said that when security found the women back inside the mall, they were confronted about trespassing, and that’s when the women became disruptive and physical with the officers.
Garcia said she attempted to tell the officers she was merely trying to get to her car, but the officers kept harassing her and her girlfriend and the situation deteriorated.
In the end, she was charged with trespassing, resisting arrest and assault on a peace officer, while her girlfriend was charged with trespassing.
Pardue said the mall’s code of conduct is posted at all its entrances, stating disruptive or disorderly conduct isn’t tolerated. IHowever, it tsays nothing about kissing.
“Our mall is a commercial venue that provides a shopping experience with respect to all races, religions and orientations,” Pardue said. “We would have enforced the same policies had it been a heterosexual couple.”
Civil rights advocates expressed dismay over the mall’s policy against public displays of affection.
“What if they’re holding hands, is that going to be enough?” asked Patrick Filyk, president of the San Antonio chapter of the American Civil Liberties Union. “Seems like a real slippery slope for management.”
