Nine social service employees charged in starvation death www.privateofficer.com
The federal indictment says MultiEthnic Behavioral Health social workers routinely failed to make home visits while managers forged documents before city audits.
Andrea Kelly pleaded guilty in state court this week to third-degree murder in the 2006 death of her daughter Danieal (Dan-YELL). But prosecutors say MultiEthnic is also culpable for doing little or no work to protect her and other needy children like her.
The now-defunct company took in $3.7 million over four years to provide in-home services. Danieal’s case worker and a company founder are also charged in state court with involuntary manslaughter.
Eight employees of a social service agency have been indicted on federal charges of defrauding the City of Philadelphia and the federal government in a case linked to the starvation death of Danieal Kelly.
The indictment against the employees of MultiEthnic Behavioral Health, Inc. alleges they billed the city for services they falsely claimed they had provided.
The City’s Department of Human Services had hired MEBH to provide services for Danieal, and the firm’s failure to do so contributed to the death of 14-year-old cerebral palsey sufferer in 2006, U.S. Attorney Laurie Magid said in a statement announcing the indictment.
The indictment contains 12 counts of wire fraud and six counts of health care fraud as well as single counts of conspiracy to obstruct a federal investigation, providing a false statement to federal agents, and perjury.
Charged in the indictment are MEBH co-founders Mickal Kamuvaka, Solomon Manamela, Earle McNeill, and Manuelita Buenaflor; and emplpyees Julius Juma Murray, Miriam Coulibaly, Christiana Nimpson, and Sotheary Chan. A ninth worker, Patricia Burch, is charged with one count of perjury.
Danieal’s mother Andrea Kelly pleaded guilty Wednesday to third-degree murder charges in the girl’s death in exchange for a 20- to 40-year prison term.

Chattanooga Wal-Mart shoplifters keep police busy www.privateofficer.com
Police responded to 490 Greenway View Drive after they received a call about a shoplifter fighting store employees, police spokeswoman Sgt. Jerri Weary said.
When police arrived, loss prevention employees had Richard Harvard in custody. Mr. Harvard needed medical treatment after a fight with Wal-Mart employees, and police helped get an ambulance to transport him, Sgt. Weary said. Mr. Harvard was taken to Erlanger hospital and a warrant was obtained for his arrest on a charge of theft under $500, police said.
While sitting in the parking lot finishing paperwork, police saw a woman run out of the Wa-Mart to a waiting car.
When approached by police, the vehicle attempted to run over the officer, but he jumped out of the way. Police gave chase to the vehicle, which quickly was disabled when the driver, identified as Carol Barnes, lost control of it after a tire went flat, Sgt. Weary said.
The suspect and her teenage son both fled on foot after the vehicle became disabled, but they were apprehended after a brief foot pursuit.
Ms. Barnes was arrested and booked on charges of aggravated assault, theft under $500and reckless endangerment, Sgt. Weary said

Nightclub keeps local police busy www.privateofficer.com
It was a wild night Sunday at the White House nightclub in Hampton Bays as Southampton Town Police made three arrests in the span of a just few hours there.
The most serious incident occurred after 4 a.m. when, according to police, Michael Kennedy, 35, of Jamesport was mistaken by others at the club as being among a group that had been fighting. He fled the club, but was pursued and as a group of patrons approached him, he pulled a loaded .45 caliber Glock from his car and pointed it at them, police said.
When a club security guard approached and identified himself, Mr. Kennedy put away his gun, police reports show.
Though Mr. Kennedy is the registered owner of the gun, he violated the conditions of his permit, which only allows him to take the gun to the shooting range, police said. Under such a permit, the owner may transport the gun to and from the range in his or her vehicle, but it must be secured and unloaded at the time. Police say Mr. Kennedy’s pistol was loaded during the incident.
Officers who were called to the scene arrested Mr. Kennedy and charged him with criminal possession of a weapon in the second degree, a felony, and criminal possession of a weapon in the fourth degree and menacing in the second degree, both misdemeanors. Mr. Kennedy was taken into police custody and held for morning arraignment.
In an unrelated incident that occurred minutes before Mr. Kennedy’s arrest, a man punched a woman in the face inside of the club because she refused to dance with him, according to police.
Officers arrested Robert Simmons, 19, of Babylon inside of the club for punching his female victim in the face causing bleeding and substantial pain. Police said Mr. Simmons did not know the woman, but an altercation erupted between the two after Mr. Simmons asked the woman to dance.
Police said the woman did not seek medical treatment for her injuries.
Mr. Simmons was taken into police custody and held for arraignment. He was charged with assault in the third degree, a misdemeanor.
A few hours earlier, around 1:47 a.m., police were called to the establishment when a nearby resident observed a man running on top of the nightclub’s roof trying to gain entry into the club by avoiding the barricades and fences.
Police arrested Tariq Rana, 18, of Coram and charged him with criminal trespass in the third degree, a misdemeanor. He was taken into police custody and held for arraignment.
