June 12, 2010 Woman sues Sears over rape by security agent www.privateofficer.com
The lawsuit claims the employee, a security guard, detained and raped the woman August 30, 2008 at the Golf Mill Shopping Center, leaving her with internal and external injuries.
A man who claims the same security guard assaulted him in connection with the incident is named as a co-plaintiff in the lawsuit, which does not specify how the two plaintiffs know each other.
Among the 95 counts named in the lawsuit, the pair is claiming assault and battery, false imprisonment and the intentional infliction of emotional distress against the guard.
The lawsuit also claims negligence and negligent hiring against Sears, Roebuck and Co. and IPC International Corp., a mall security company, in addition to claims of spoliation of evidence. According to the lawsuit, the defendants “altered and/or erased the recorded evidence” from security surveillance cameras that was relevant to the alleged attack.
The plaintiffs also claim negligence against the makers of the mall’s surveillance system, Firetide, Inc., alleging the cameras failed to properly monitor the guard, according to the lawsuit.
The lawsuit seeks damages of at least $50,000 for each count, plus the costs of the lawsuit.
The Niles Police Department could not immediately comment on the alleged incident Friday evening.
