Austin TX Sept 14 2010 A 52-year-old man is facing felony assault charges after police said he attacked a security guard at a bar where staff refused to keep serving him and his two friends then threw them out, according to an arrest affidavit.
Police said Jose Alberto Fuentes was at the Texas Bar at 1502 E. Sixth St. on Friday with two friends when they were all cut off from ordering any more alcohol and asked to leave the bar, according to the affidavit. It said the bartender on duty saw one of Fuentes’ friends falling asleep at the bar. When asked to leave, the three men became very upset and threatened the bartender, the affidavit said.
A security guard escorted the men out of the bar, but Fuentes grabbed a wooden cane from a nearby car and attacked the guard, the affidavit says. It says the guard was hit in the head at least five times by Fuentes, and the bartender saw the incident occurr. The guard had a large welt on his right temple and was covered in blood, police said.
When police arrived, Fuentes attempted to flee in the car, but was blocked in the parking lot by police, according to the affidavit. Fuentes was arrested and charged with aggravated assault and evading arrest, which could land him a total of 30 years in prison if he is convicted. He remained in the Travis County Jail on Monday with bail set at $50,000.
