Pikeville KY May 26 2011 The U.S. Department of Labor announced Tuesday that it has recovered more than $118,000 in back wages for some security guards in Eastern Kentucky.

After an investigation found that 44 employees of Appalachian Security Inc. had been mistakenly classified as exempt from the Fair Labor Standards Act’s overtime pay provisions — and had been denied appropriate compensation — $118,465 in back wages were recovered, a Labor Department news release said.

The Pikeville-based company had classified some guards as exempt from the FLSA. Instead, they were paid hourly and did not meet exemption requirements, the release said.

The company has agreed to pay all back wages and has committed to properly classifying all future employees.
