Biloxi man gets 37 years for sexual battery, child porn www.privateofficer.com
BILOXI MS Nov 30 2012 – A judge has sentenced a 29-year-oldBiloxi man to 37 years in prison for coercing a 3-year-old girl to perform sex acts on him and for having hundreds of pornographic pictures of young children on his computer.
Judge Roger Clark sentenced Johnathan Robert Necaise to 30 years for sexual battery and seven years for exploitation of a child, which is the state’s charge for having child pornography.
Clark ordered Necaise to serve the sentences consecutively. His prison terms must be served day for day.
The judge described the crimes as “reprehensible” at Tuesday’s sentencing in Harrison County Circuit Court, Assistant District Attorney George Huffman said.
Necaise was arrested Aug. 19, 2011, after a child told someone about sexual activity with him.
“The little girl described a game that she and Necaise played and how she was told by Necaise not to tell anyone about the game,” Huffman said.
Necaise told a Biloxi police investigator the girl had performed oral sex on him between two and five times. Police searched his home and found more than 300 pornographic pictures that showed “he clearly had a preference for young children,” Huffman said.
Necaise pleaded guilty Oct. 16 while a jury sat in another room waiting for his trial to start. He faced maximum penalties of a life term for the sexual assault and 40 years for child porn.
Mississippi law requires sentences for sex crimes against children be served without the hope of early release or parole, District Attorney Joel Smith said.
“To protect the future of our society, we have to be vigilant in the protection of our young people,” Smith said. “Crimes such as this are a complete betrayal of the trust between a child and an adult.”
