Family of murdered security officer denied closure www.privateofficer.com

Cincinnati OH July 18 2010
By: Rick McCann/CEO
PRIVATE OFFICER INTERNATIONAL
http://www.privateofficer.com

An Ohio family today still has no justice in the killing of their loved one who was gunned down in 1999 while working as a security officer.
It all started at a New Year’s Eve party in Cincinnati, Ohio.
The Oasis bar and grill, a popular local club was filling up fast as the celebration of another New Years was fast approaching.
Police say that as the night wore on, a fight broke out and bar security officers began pushing people toward the front of the bar and out the doors to de-escalate the situation.
That’s when one of the brawlers returned within moments with a gun and began shooting into the business.
Jerry Gilbert, one of the nightclub security officers was found laying on the ground with a bullet wound. A fellow security officer started first aid but Gilbert died on the scene from his wounds.

Investigators were able to identify a suspect in the murder and named Cyril L Byrd as their prime suspect and with the assistance of the FBI, the U.S. Marshals office and Americas Most Wanted television program, officers across the country began their manhunt.
Somehow Byrd had managed to avoid capture and stay one step ahead of law enforcement for almost nine years until an AMW tipster lead authorities to Arizona.

Arizona authorities were familiar with Byrd because they had arrested him in 2005, but Byrd allegedly used an alias and posted bond before cops realized he was wanted for an Ohio murder.

So, when an anonymous tipster called the Phoenix field office of the FBI, they knew just who the tipster was talking about, and they were not taking any chances with the man they say was a violent fugitive.

At around 3 p.m. on Monday, September 17, 2007, members of the FBI’s Violent Crimes Fugitive Task Force went to the address and they were able to take Byrd into custody without any resistance and he admitted to officers who he was. Investigators found a weapon and cash inside the home, but thankfully no one was hurt during the arrest.

With the fugitive in custody they extradited him back to the State of Ohio so that justice could be served and the family of security officer Gilbert could at last find closure.
But closure would be denied by Hamilton County judge who said that there was not enough evidence to proceed with murder charges against Bryd and on Nov. 18, 2008, he was acquitted of the charges against him and set free.

Authorities in Cincinnati still say that they beleive that they had the right man in custody for the murder but the case is now in the hands of the Cold Case Squad who may be able to turn up new leads as they start the investigation process all over again.

In the meantime, Gilbert’s family now wonders if they’ll ever see justice or have the true peace that can only come  with the arrest and conviction of the man who killed their loved one.

Police departments cancel services, lay off staff and close for good www.privateofficer.com

Charlotte NC April 29 2010
By: RICK MCCANN/STAFF
PRIVATE OFFICER NEWS NETWORK
http://www.privateofficer.com/

For the past two years, police and sheriff departments have struggled to maintain their agencies with less money, fewer officers and no new equipment.
There has been lay offs and furloughs of “non-essential” personnel including civilian employees, community service officers, animal control officers and in some cases a few law enforcement officers here and there.

But, as time goes on and the economy is reportedly getting better, many public safety agencies are still having to fight to staff their jails, patrol cars and provide an acceptable level of service to the public that they are sworn to serve and protect.

In Birmingham Alabama the Jefferson County Sheriff’s Office was forced to lay off several dozen patrol deputies for a number of months because they simply did not have the money to make payroll.

And they’re not alone. Police and sheriff departments in at least 43 jurisdictions have decreased their staff, their coverage area and the services that they will now provide.
Just these week two other departments, Charlotte Mecklenburg North Carolina and Ingrham County sheriffs Department in Michigan have taken steps to downsize their departments.
About ten years ago, the Charlotte police department combined their agency with the Mecklenburg County Police and became the CMPD. That move greatly increased their staff numbers as well as their response area and brought needed resources and increased budgets to both agencies.
But that was then and this is now. Now CMPD is taking a serious look at removing the Mecklenburg County name from their department and restricting services and response areas to the city limits of Charlotte, leaving those living in the non-incorporated areas of the county without police service.

After years of cuts to the Ingham County Sheriff’s Office they have relinquished most patrol duty to other agencies and this week the county commission has said no more.

“The office has lost 42 positions in the past three years,” Commissioner Randy Schafer said. “The road patrol is about non-existent.”

The Ingham County Board of Commissioners made a decision Tuesday that was a long time coming.

“This is culmination of folks understanding we do have budget problems and our only option is to target the more discretionary items,” Chairperson Debbie DeLeon said.

Tuesday’s vote didn’t make it official, but it showed the board’s intent to eliminate county road patrol services effective January, 1 2011 — a move that would go along way in cutting down the county’s $5 million budget deficit.

“I think this is a sad day,” Ingham County Sheriff Gene Wriggelsworth said. “Most counties are hurting and are in trouble, but I think public safety should be the first priority, not the last.”

Leslie Township Supervisor Dallas Henney had hoped this day would never come.

“I don’t think the folks of Ingham County want to live without road patrol,” Henney said.

He said the 13 outlying townships and one village have come together and are considering an alternative — creating a township-wide police authority and paying for patrols themselves.

“We are looking at a special assessment, everyone in the county would pay the same amount, no matter how big or small your house is,” Henney said. “The thought is if you use the service, everyone should pay the same amount.”

Each township will decide to either fund this idea or not.

Henney said they don’t know if it will be on the August ballot or November’s.

If the money is not there to adequately fund city and county law enforcement agencies there will be more of this said Ronnie Parks, a professor of law. The public in some ways will have to except less services, slower responses and in some cases, no response.

Security officer rescued from flooded mall www.privateofficer.com

Warick RI April 1 2010
By: Rick McCann/Staff
PRIVATE OFFICER NEWS
http://www.privateofficer.com

Emergency crews continued their rescue operations as flood waters continued to swamp many areas of the city.
Police said that a mall security officer also had to be rescued from the Warwick Mall because he was stranded inside the shopping center on Wednesday.
Firefighters were able to use a boat to get the mall security officer out.

“He had been there for the last 24, 25 hours or so, and they felt as though it was getting to be a situation where he might have been panicking a little bit, a health issue,” said Bruce Cooley of the Warwick Fire Department.

Water had completely flooded out the parking lot right up to the mall doors.

That guard had refused to leave his post even as the mall area flooded.

Gov. Don Carcieri has ordered the continuation of the state of emergency in effect from the storm two weeks ago.

The Pawtuxet River, which is expected to reach an all-time high of 20 feet, flooded homes and backyards in Warwick on Tuesday. Some local emergency crews evacuated residents and responded to those in need via wave runners.

“We don’t want anybody to be caught in a situation where there is a flash flood or where it rises so quickly that they’re trapped in their property. It puts not only those families but the responders at risk to get them out of there,” said J. David Smith of Rhode Island Emergency Management Agency.

Authorities said that the security officer was in good condition but did not release his name.

Police charging for their services www.privateofficer.com

Atlanta GA March 16 2010
By: Rick McCann/Staff
PRIVATE OFFICER NEWS
http://www.privateofficer.com/

Strapped for cash and working with fewer officers police and sheriff departments are now doing what they must do to keep their department afloat including charging for services.
While it has been no secret that many departments have been charging business and in some areas residents for false burglar alarms, now law enforcement agencies are planning to charge for other routine or specialized services.
According to Capt. Brady a police spokesperson in Texas, many departments especially smaller ones can not afford to have their officers tied up directing traffic after church services or at a busy intersection during a special event, concert or convention for free.
So now, many police agencies are turning to the event promoter or civic centers where the event is being held and charging them for the police manpower being used to patrol the area to keep it safe, direct traffic or other related duties.
Police are also charging to respond to private property accidents and even accidents occurring on public streets where non-residents are involved.

In Mississippi, DeSoto County Sheriff Bill Rasco says an attorney general’s opinion supports his claim that Mid-South Fair organizers owe his office $27,000 for overtime for deputies providing security.
Rasco and Southaven police paid law officers overtime during the October fair to control traffic and provide a police presence.
Southaven is not seeking reimbursement. But Rasco said it is only fair a profit-making venture pay for extra protection.
Rasco said the attorney general opinion says “the sheriff is not a security guard company and is not required to provide security to events free of charge.”
Mid-South Fair general manager Jim Rout said he had not seen the opinion and could not comment.

And in St. Petersburg Florida it may become more expensive to cause a car crash. Ocala, Brookesville and Port Richey are just a few Florida cities that already bill non-residents for emergency services if they caused the accident.
While those towns collect tens or hundreds of thousands of dollars, “doing both police and fire- that number could be well over a million dollars,” said St. Petersburg City Councilman Jim Kennedy.
He calls the charges a “user fee” imposed on people who are not property taxpayers.
“I don’t think the average citizen understands how much of the services that they pay for are provided to people who are not residents of the city,” Kennedy adds.
St. Petersburg Fire Rescue and Police administrators are now developing possible schedules of fees and city attorneys are writing a possible ordinance. Charges for emergency services could add up fast.
“For an accident with injuries we send one fire truck and one rescue truck. The fire truck’s there for hazard mitigation and also they assist the paramedics with patient care,” said Fire Rescue’s Lt. Joel Granata.
That means there are at least five or six firefighters and paramedics in the first response, then more are called if there is an extrication or a hazmat situation. They may be on the scene for an hour or more.
Police officers control traffic and investigate causes of the crash.
Kennedy proposes billing insurance companies first, then individual motorists if the insurance carrier refuses to pay.
“And that individual would probably be going back to their insurance carrier saying I purchased coverage to pay for this” Kennedy predicts.
And this trend in law enforcement is catching on in Colorado, Ohio, Texas and Georgia. Many police administrators are looking at ways of paying for their officers to be on the streets since the hard hitting budgets have put officers on furloughs, closed sub-stations and put a hiring freeze with no hiring anytime soon.
But the U.S. is not the only place where police now are charging for what once was free. The Constabulary in the UK and Canada are permitted to charge for the policing of certain events, including football matches, visits by VIPs (not Royalty), for custody use, commercial events, charitable events, community events, statutory events and private functions as well as traffic control and certain private response.
As with any business needing to make up shortfalls, police agencies are becoming creative as they apply user fees and other charges for police services that once were offered to the public free.

Riots this week have lead to arrests, injuries and chaos on two different U.S. university campuses on the opposite sides of the country. Neither onset of violence had the same theme or the same outcome.

Police n College Park, Md. said that a basketball victory prompted massive riots and a whole lot of ruckus after the University of Maryland upended fourth-ranked Duke University at the Comcast Center Wednesday night.
The win puts the Terrapins in a first-place tie with Duke’s Blue Devils in the Atlantic Coast Conference which was cause for a huge celebration.
Students poured out into the streets of College Park both on and off the campus and began to scream, dance and throw things as they worked themselves up into a frenzy.

According police they had trouble clearing the thousands of students who had gathered in the streets and eventually was forced to use pepper spray and even call in a helicopter
to help with the escalating situation.

“We were hopeful it wouldn’t happen, that they would come out and celebrate in another way, but we prepared for that case, and it did happen,” University of Maryland Police spokesman Paul Dillon.

On the west coast, rioters and protesters clashed with police at the University of California, resulting in arrests and injuries.
Five students were arrested Monday during the UC Student Association’s annual lobbying day in Sacramento. Police arrested two people off campus during riots in Berkeley early Friday morning.
On campus on Monday, roughly 200 people silently demonstrated to draw attention to racial tensions at Berkeley and across the UC system. The students sat in front of Berkeley’s Sather Gate before moving to California Hall to deliver a letter intended for UC–Berkeley President Robert Birgeneau. (Birgeneau wasn’t on campus.)

The state of California has been dealing with countless protests—some peaceful, some violent, some destructive—since the state’s university system raised fees 32 percent and slashed education funding. It only adds to the pressure Berkeley is already feeling when students are upset about perceptions of racial discrimination at schools within the UC system.

- An Indiana woman who went to the Great Smokey Mountains with her boyfriend to get some rest and relaxation spent days of being terrorized and beaten by that same person.
Police said that it all began as an enjoyable vacation but now the man is awaiting trial on allegations that he handcuffed and bound his girlfriend while threatening to bash her head with a hammer and remove her fingernails with pliers.

Ernest H. Pyle, 45, of Milan, Ind., is being held today under a $250,000 bond awaiting trial on charges of aggravated kidnapping and resisting arrest, according to Pigeon Forge Police Chief Jack Baldwin.

Pyle allegedly held his girlfriend, 30-year-old Kathy Miller, of Cincinnati, Ohio, captive for two days before she was able to escape her binds and seek aid from a motel clerk, Baldwin said.

The chief said Pyle and Miller checked into the Grand Inn, 3206 Parkway, on Feb 18. Five days later, however, Miller told Pyle she was ready to leave, prompting an allegedly violent reaction.

Baldwin said Pyle handcuffed Miller’s hands and used duct tape to cover her mouth and bind her feet. Miller told police Pyle cut her clothing off with a knife and punched her in the stomach.

“He threatened he was going to kill her and wrap her up in plastic and leave her on the side of the road,” Baldwin said.

To reinforce his threats, Pyle went to a WalMart and bought a hammer and a pair of pliers, Baldwin said. The hammer, Pyle allegedly told her, would be used to kill her with blows to the head after he used the pliers to yank her fingernails out.

Police said that Miller was able to free herself about 9:23 p.m. Feb. 25 and ran to the desk clerk for help, the chief said. Baldwin said the clerk notified the hotel security officer for help and they placed Miller in another room and alerted police.
As officers responded to the call, the security officer met Pyle as he returned to the motel in his silver pickup truck after making a run to a store. As security was talking with the man, a Pigeon Forge officer approached and Pyle fled and had to be chased down on foot.

Baldwin said Miller was not hospitalized because of her injuries.

Her relatives came to Pigeon Forge to take her home, the chief said.

Police have arrested a 22-year-old school bus driver after an investigation into sexual misconduct.
Investigators say that Gian Carlos Mirabel of Lawrence has been charged with child rape Monday.
Mirabel already plead not guilty in Lowell District Court.

Authorities say starting in the fall of 2009, Mirabel would ask the girl to stay on the bus after dropping off the other students, then drive to another area where the alleged assaults took place.

The alleged assaults were brought to the attention of authorities by another employee of the bus company, who noticed suspicious activity between the suspect and the girl while reviewing security footage of a minor bus accident.

Investigators were able to gather enough evidence to secure an arrest warrant for the bus driver who is currently being held on a $50,000 bond.
It is not known if any other students were victims of this bus driver or whether or not he has an attorney at this time.

Powerful “Legal Pot” surfacing everywhere www.privateofficer.com

ATLANTA GA March 2 2010

PRIVATE OFFICER NEWS
http://www.privateofficer.com/– Law enforcement agencies say that they are concerned about a new kind of pot that’s being sold legally and right now there’s not much that they can do about it.
It looks like potpourri, but is smoked like pot and according to kids that are smoking it, this stuff feels just like marijuana but even stronger.

The herb like substance can be found at local smoke shops and gas stations marketed under names like K2, Sunset Gold and Nirvana and its availability is becoming more widespread and easier to find police say.

The packaging describes the herb as “not for human consumption,” but that has not deterred those looking for a legal and undetectable high.

Dr. John Huffman a Research Chemist with Clemson University in South Carolina says, “It has the effects of THC, but it’s about ten times more potent.” One of Dr. Huffman’s students discovered a synthetic form of THC, the active ingredient in marijuana, while studying the effects of pharmaceuticals on the brain.

“Then, somehow people got the bright idea of spraying this onto or fixing it with plant material and smoking it,” he says, “I don’t feel responsible for the misuse of a substance that was designed for research, you’re dealing with an unknown substance, it’s a little bit akin to playing Russian roulette.”

Since synthetic THC is so new, there is no research on it’s toxicity and potential to harm smokers. Some doctors have reported users suffering from hallucinations, vomiting and even seizures.

Drug counselor Dr. Robert Margolis of Solutions Outpatient Program in Roswell Georgia said that a number of his patients have used the drug. He said, “This is easy to obtain, if you have the money and secondly it’s not detectable in a drug screening. It is addictive, it’s a dangerous drug and lastly we don’t know what the long term affects are going to be.”

Store clerks in Georgia and South Carolina report that the herb sells fast and one store told us that they can’t keep enough of it on their shelves. Within a day or so of getting a shipment in, the stuff flies out the door a clerk told us.

Right now there are only a few states who have taken steps to ban K2 and similar drugs though more will likely introduce laws to prohibit as the awareness of this herb becomes wider known said a law enforcement agent.
