Three people suspected in last month’s attack with an electric stun gun during a shoplifting incident were arrested after being detained on suspicion of theft at the Knoxville Center mall.
Knoxville Police Department Officer Josh Hurst responded at 7:52 p.m. Monday to a shoplifting call at JCPenney at Knoxville Center, said KPD spokesman Darrell DeBusk.
When Hurst arrived, he recognized the detained trio as the suspects wanted in connection with the Dec. 29, 2008, attack on an employee of the Best Buy store at 8925 Town and Country Circle. In that 6:46 p.m. incident, a Best Buy employee was struck by a stun gun on the arm or shoulder after he demanded a receipt from the trio for two laptop computers they were carrying.
The employee was not seriously injured but was treated at a hospital.
DeBusk said the arrested people are Brandi Marie Berry, 21, of Clinton who was being held in jail in lieu of $12,500 bond on two counts of assault and two charges of shoplifting; Dustin Norman Sanborn, 21, of Knoxville who was being held in jail on a $15,500 bond on charges of theft, violation of probation, aggravated robbery and possession of drug paraphernalia; and Apollo Lance Nicholes, 23, of Powell who was held in jail in lieu of $4,000 bond on charges of theft by shoplifting, evading arrest and resisting halt and frisk.
Nicholes also was held for Roane County authorities on a violation of probation charge stemming from previous convictions of voluntary manslaughter and felony recklessness, DeBusk said.
DeBusk said the investigation into the trio did not turn up the electric stun gun allegedly used at Best Buy.

Best Buy employee charged with theft over $10,000 http://www.privateofficer.com
Fort Smith Ark. Dec 28 2008 – An 18-year old Best Buy employee faces theft charges after store officials discovered more than $10,000 worth of electronic products were missing, according to a Fort Smith police report.
Gary Brown Jr. of Van Buren was arrested Sunday on a charge of felony theft. Officials at the Best Buy at 4195 Phoenix Ave. told police that over the past three weeks, 39 iPods, two cell phones, a laptop computer and a digital camera were taken.
Brown has been released from the Sebastian County jail on a $3,500 bond. It couldn’t be determined Wednesday if formal charges have been filed.
The police report listed six other Best Buy employees as suspects, but no other arrests have been made, according to police records.
Police spokesman Sgt. Levi Risley said one of the suspects, Cory Evans, 18, of Muldrow, Okla., was arrested Sunday on an unrelated felony shoplifting charge that also involved Best Buy merchandise. Jail records show he was released Sunday after posting a $1,500 bond.
The police report stated Brown admitted taking several items. He said he unloaded trucks at the store and would put items in an empty box and throw it into a large trash compactor. When the compactor was full, he would climb in to collapse the boxes in it and would place the stashed items in his pockets and leave with them.
He said he sold many of the items.
Brown told officers he threw the items into the compactor because he knew there were surveillance cameras in the loading area but that inside the compactor was out of their range.
Store officials became suspicious because products ordered were missing, the report said. Surveillance camera footage showed suspicious activity, but the thefts were not witnessed because there were no cameras in the compactor.

A lawsuit filed against the Boynton Beach Police Department, one of its officers, and Best Buy department store this month claims a woman was falsely arrested for shoplifting and received “physical and emotional injuries” as a result.
Attorney Christopher Haddad says his client, Latara Blackman, now 20, bought a CD on Feb. 21, 2007, at the Best Buy in the 1700 block of North Congress Avenue in Boynton Beach.
While leaving the store, an employee accused Blackman and her friend of shoplifting, according to the lawsuit.
They spoke with a manager who told them they were caught on video and police were on their way.
Officer Michael Mulcahy arrived and, according to his arrest report, Blackman and her friend confronted him with profanities and hostility.
Haddad says that’s a lie and that they were not stealing .
Haddad says that’s a lie and that they were not stealing .
In a letter he sent to the police department in September 2007, he asks for a $100,000 settlement to prevent the lawsuit, which was filed Friday.
The police and Best Buy said they had not received the lawsuit Monday and declined to comment.
Mulcahy said in his report that Blackman kept grabbing his arm as he tried to arrest her friend, Cynthia Harris, now 20.
While other officers tried to arrest Blackman, she slapped their hands and pulled away, the report said. Blackman, of Lake Worth, was charged with assault on a law enforcement officer and resisting arrest without violence.
The charges were later dropped. Blackman wants to be a nurse, her attorney said, and the arrest gave her a stigma she has yet to shake.”It was very disruptive toward her goals at the time and could still have a lasting effect,” Haddad said.
