Credit union robberies were inside job http://www.privateofficer.com
chron.com A recent armed robbery at a Spring-area credit union was an inside job a former employee planned with accomplices, federal investigators said Tuesday.
Authorities said the worker also admitted planning and robbing the same credit union a few months earlier.
Houston residents Dorcell Devon Johnson, Dominique Sherrard Ervin, both 19, and Carl Edward Preston Jr., 18, are accused of bank robbery in a criminal complaint.
Investigators say they stole about $200,000 on Nov. 5 from Investex Credit Union in the 200 block of Cypresswood.
In a hearing Tuesday, U.S. Magistrate Judge Calvin Botley ordered the trio held without bail while they await trial because he said they pose a danger to the community.
No trial date has been set.
Johnson’s, Ervin’s and Preston’s defense attorneys said they could not comment because they have not had time to review all of the evidence.
According to authorities, Johnson was a customer service worker at the credit union when it was robbed. He was on duty when Preston and Ervin, wearing masks, stormed the bank brandishing shotguns, officials said.
Preston, investigators said, pointed his gun at the credit union’s security guard and took his pistol and cell phone.
He and Ervin then allegedly marched the guard and Johnson to the bank vault, where another employee was working. The gunmen ordered the employees to stuff money into a bag, authorities said.
Then Ervin shot the screen of a security camera television monitor in the vault, and he and Preston fled in a white four-door car that they had parked nearby, officials said.
Kevin Katz, an FBI special agent, testified Tuesday that police became suspicious of Johnson when they watched surveillance tapes of the heist because he appeared to be unafraid during the robbery.
“This is an inside-job bank robbery,” said Assistant U.S. Attorney David Searle.
Investigators said Johnson had worked at the credit union about two years. He no longer is employed at the institution, they said.
The Harris County Sheriff’s Office alerted investigators Dec. 18, authorities said, after a deputy found three shotguns and money bundled in stacks with straps marked with the credit union’s name in Johnson’s apartment.
The deputy had gone to the apartment because the landlord called police about a gunshot fired in the unit. No one appeared to be injured.
No one was at the apartment when the deputy arrived, but the landlord unlocked the door and the deputy went inside to check if anyone was hurt.
When investigators spoke with Johnson about the money and guns, he admitted that he had helped plan the theft and that Ervin and Preston were the gunmen, authorities said.
Investigators said that he told Ervin and Preston details about the bank and that they split the stolen money.
Investigators said Ervin and Preston also admitted their roles in the heist.
Johnson further said that he had planned a robbery at the same credit union Aug. 27 with another accomplice.
In that robbery, investigators said, a masked gunman netted about $126,000. Investigators said they have yet to determine the robber’s identity in that bank job.
About $6,000 of the money stolen in the two heists has been recovered.
Investigators said they also received a tip that Johnson, Preston and others had planned to rob another Spring-area bank.
If convicted of bank robbery, Johnson, Ervin and Preston each face up to 20 years in prison, Searle said. Their sentences could be increased because guns were used.

Two off-duty police officers working as security officers at an area nightclub shot and killed a man who refused to drop a gun that he allegedly fired several times in the parking lot of a Brazoria County nightclub early Saturday, authorities said.
The two off-duty Clute police officers who were working security at the Habana Night Club in the 14000 block of Highway 288 were in the process of clearing the parking lot of patrons around 2:10 a.m. when 21-year-old Kory Smith, of West Columbia allegedly displayed a small caliber handgun and discharged several rounds according to an official Brazoria County Sheriff’s Office statement.
When the officers confronted Smith and told him to drop the weapon, he ignored their commands and leveled the gun at them, authorities said.
The officers then discharged their weapons an unknown amount of times, striking Smith who was taken to Angleton Danbury Hospital, where he was later pronounced dead, authorities said.
Smith’s body was transported to the Galveston County Medical Examiner’s Office for an autopsy, officials said.
The statement did not specify how many shots were fired at Smith of where he was shot.

Authorities also charged a second person Wednesday, accusing her of being involved in a death-row inmate’s possession of a phone.
Texas Department of Criminal Justice officials also said officers have seized at least one subscriber identity module, or SIM card, a postage-stamp-size tool that plugs into cellphones and transfers information from one phone to another.
The prisons have been locked down since Monday evening after Gov. Rick Perry ordered agency officials to ferret out any contraband.
The order followed the disclosure that death-row inmate Richard Tabler had made threatening calls to a state senator and had shared his illegal cellphone with at least nine other inmates.
Late Wednesday, officers transferred Mr. Tabler to a prison psychiatric facility after finding that he had ripped a 3-foot piece of bedsheet and attached it to a fixture in his death-row cell.
The 10 condemned prisoners made 2,800 calls in nearly a month, and the inmate’s mother, Lorraine Tabler, was arrested Monday and jailed on suspicion of paying for phone minutes.
Mr. Tabler’s sister, Kristina Martinez, surrendered to police in Killeen on Wednesday after she was named in a warrant charging her with providing the phone. Officials said earlier that a guard had been bribed.
Criminal justice department spokeswoman Michelle Lyons said it could take three weeks to complete the search of large prisons, some of which – including the Polunsky Unit, where death-row inmates are housed – have more than 2,000 inmates.

More than 30 Houston police officers face suspension or a departmental reprimand after an internal affairs investigation concluded that they worked at part-time jobs while still on the clock for the city.
The Houston Police Officers’ Union said the punishment handed down by HPD amounted to an overreaction to long-standing — if unofficial — patrol officer practices.
“They wanted to fire six or seven of those people. We ended up getting into a mediation (with HPD) and negotiating most of those deals out,” said HPOU President Gary Blankinship.
Patrol officers generally arrive at work 15 to 20 minutes early so they can sign for their cars and pick up any special equipment they might need. That way, HPOU officials said, the officer can respond to an incident when the shift begins.
The patrol officers generally return to the station a few minutes early so they can turn in paperwork and equipment. Blankinship said the focus of the yearlong inquiry seemed to be on those officers who made the handover quickly and went to their part-time jobs while still technically on the city’s payroll.
“The majority of these cases were under 30 minutes,” Blankinship said.
At least one of the officers often worked extra hours on a narcotics assignment when there was no overtime money in the budget, Blankinship said.
Capt. Dwayne Ready, the Houston Police Department’s former public spokesman, was suspended for using his work computer to send e-mail about his private security business, Blankinship said.
The department forwarded the results of the investigation to the Harris County District Attorney’s Office.
“They declined any charges on anybody. No criminal activity occurred,” Blankinship said.
Police officials were not immediately available to comment on the investigation.

Houston News Chopper Crashes, 2 Dead http://www.privateofficer.com
Two people were killed. Authorities have now identified them as pilot John Downhower and photographer Dave Garrett.
The chopper went down in a heavily-wooded area after responding to a triple shooting call near 1488 and Peoples Road.
Harold Robinson, who lives near the crash site, told 11 News that he heard the helicopter and then an explosion. He said he called 911.
It was unclear what caused the crash.
Thick smoke could be seen rising from the site, and debris and flames were scattered among the trees.
Part of the tail of the aircraft, bearing its logo, was visible on the ground near the scene of the crash.
Rescue quickly extinguished the flames, leaving a large charred area in the woods.
The National Transportation and Safety Board will conduct an investigation into the cause of the crash. There’s no immediate word on what went wrong. Communications between the chopper and the TV station stopped right at the time of the crash. Witnesses in the area reported hearing the crash and explosion.
“It’s a terrible loss for our community and our industry. Our hearts go out to our colleagues at KTRK,” KHOU-TV/DT’s Executive News Director Keith Connors said.
On their Web site, KTRK confirmed the identities of those on board and said that there was no other victims.

Armored truck robbery nets robbers six figures http://www.privateofficer.com
HOUSTON TX Aug 8 2008
By: Bryan Hill
Ntl. Assoc. Private Officers
http://www.privateofficer.com/ Several persons held up a local armored truck and it appears that they got away with possibly six figures in the heist.
It happened on JFK Boulevard and Aldine Mail Route in northeast Houston. Harris County investigators call the robber bold for confronting guards with guns.
The owner would not talk to area televison reporters on camera but he did show them surveillance video of the robbery and while authorities are not saying exactly how much was stolen, the owner says he was expecting $100,000.
It’s a risky business”, said Mark Clark, Loomis Senior Vice President of Strategic Growth and Communications.
According to surveillance video viewed , the armed robber was waiting for the armored truck. When it arrived, one female guard checked the surroundings. The other got out with two bags of cash and was met with a gun. The crook then took hers.
“While the suspect disarmed the female guard, the guard was not hurt,” said Sgt. Noel Araguz with the Harris County Sheriff’s Office. “Nobody in this establishment was injured in this ordeal.”
The robber took off and within minutes police and detectives were at the scene.
According to Loomis, last year there were approximately 75 armored car robberies nationwide.
In Houston the average, says an FBI spokeswoman, is one to two a year. The last big heist in Houston was in 2004 when almost $4 million was stolen from Triple D Security. That turned out to be an inside job.
Strict policies and procedures are in place for guards to follow.
There were three at Wednesday’s robbery. One must always stay in the truck. Loomis’ Mark Clark would not discuss the specifics of what happened, although he says all guards are armed and their priority is to avoid an incident.
“We don’t want gunfire on the streets. We don’t want to put people at risk so it is a last resort, but if it comes to the last resort, they are well trained,” said Clark.
Neither of the two guards who remained armed fired their guns.
Investigators say all the guards are cooperating and they believe the robbery is legitimate. The robber got away in a green Pontiac sedan, possibly a Grand Am or Grand Prix.
Call Crime Stoppers at 713-222-TIPS if you have any information about the crime.

Houston security officer shoots, kills armed man http://www.privateofficer.com
It happened near the Houston Ship Channel just after 1 a.m.
Investigators believe a security officer who was on duty at the Maria Bonita Tavern prevented a patron from entering, and an argument ensued.
Both the security guard and the patron reportedly pulled out weapons and started shooting.
After the shots were fired, the patron, who had sustained a bullet wound, returned to his car and left the scene. He drove a few blocks before careening into a ditch where a passing motorist found him and called 911.
Now police are asking questions as they conduct their investigation into whether this was a case of justified self-defense or a serious case of assault and murder by the security officer.
Police found the wounded man there and rushed him to Ben Taub, where he later died.
Police have yet to determine if charges will be filed against the security guard.

Father leads police to childrens bodies http://www.privateofficer.com
Investigators suspecting foul play had question the children”s father who had repeatedly denied involvement and would not fully cooperate with authorities.
But police say that on Friday, the father of the two missing children led investigators to the children’s charred remains.
Police found the remains of 7-year-old Randy Sylvester Junior and his 3-year-old sister Denim packed in a wooden chest and a suitcase and left in a wooded area in southeastern Houston. The bodies were found about 5 miles from the children’s home in suburban Pasadena.
A Pasadena police spokesman says the children’s father, Randy Sylvester Senior, led searchers to the remains late Friday after a week of misleading statements about where the kids were located.
Sylvester who was jailed on an assault charge stemming from an alleged attack on the children’s mother was still in custody and charges of murder will now be filed against him. Investigators would not discuss the details of the deaths but say that there had been a domestic disturbance and the rest will come out later.
The discovery of the bodies ended a week of turbulent emotions for police, searchers and the children’s family and friends.
Former cop sent to prison over secuirty firm violations www.privateofficer.com
Houston Tx. Nov. 7 2007
A former Houston police officer whose private security firm armed illegal immigrants to work as security guards was sentenced to more than three years in prison Monday.
David Rodriguez, 39, pleaded guilty last year to conspiracy to violate various federal laws as the owner and operator of Bayou City Patrol Division.
Rodriguez, his father and Bayou City were charged in July 2006 with falsifying forms to allow illegal immigrants to carry guns and obtain state security licenses. The company employed about 50 guards, mainly for apartment buildings and bars in west Houston.
In May, Bayou City was convicted and sentenced to one year probation. The shuttered company has surrendered its security commission and firearms, Assistant U.S. Attorney Abran “Abe” Martinez said.
Rodriguez, a 13-year HPD veteran, admitted lying on federal forms to buy handguns. In his guilty plea, Rodriguez said he sold the firearms, without a license, to Bayou City’s illegal workers. From December 2000 through December 2005, Rodriguez hired people who fraudulently acquired security guard commissions from the state by using false social security numbers and biographical data.
Three weeks ago, Rodriguez asked U.S. District Judge Vanessa Gilmore to throw out his guilty plea. She refused. In the request, he insisted that his plea was entered “under false impressions” and that he was “out of it” and “did not understand the consequences.”
Defense lawyers Shelly M. Davis and Jonathan H. Cox prevailed in getting Rodriguez a shorter sentence than prosecutors wanted.
“I think the judge was fair,” Davis said.
Martinez, who had asked Gilmore to add at least another year, also said the sentence was fair.
Rodriguez, who eventually resigned from the police department, was not immediately taken into custody. Gilmore allowed him to remain free on bond pending a court order to surrender to federal prison.
Martinez said he intends to drop all 15 charges against Rodriguez’s father, Manuel Rodriguez, whose trial was scheduled for next week
