decaturdailyonline.com A second-grade teacher is out of jail on $15,000 bail after Decatur police arrested her Monday on a grand jury indictment for sexual abuse.
A Morgan County grand jury handed down the indictment July 23 against Danville-Neel Elementary teacher Jessica Heather Defoor, 35, on second-degree sexual abuse and enticing a child for immoral purposes charges, said Attorney General Troy King.
The charges stem from an incident reported to police in late 2007 by the mother of the victim, a minor female, said Lt. Jonathan Green, Decatur police public information officer.
The sexual contact allegedly occurred in February 2006, he said.
Police said the victim was not a student of Defoor’s and the reported incident did not occur at school. The mother of the victim claims Defoor touched her daughter inappropriately at Defoor’s Decatur home, according to the sworn affidavit issued at the city’s magistrate’s office in July 2008.
The victim alleged Defoor gave her alcohol, exposed her breasts and touched the victim’s breasts through her bra, according to the affidavit.
The victim also accused Defoor of other inappropriate touching and said a male of an undisclosed age was also involved in the incident.
Defoor has been on paid administrative leave since early in the 2007-08 school year, according to Glenn Lang, the school’s principal. He placed Defoor on paid leave after investigators informed school administrators of their investigation into the victim’s allegations, Lang said.
“If convicted, Defoor faces a maximum of one to 10 years for the enticement charge, and up to one year imprisonment for the second-degree sexual abuse charge,” King said.
Even if convicted on the charges, Defoor could still draw pay and benefits if she chose to appeal the conviction. If Defoor is terminated upon her conviction, she could also appeal her firing.
Tenure law
The state’s teacher-tenure law requires educators receive pay until a hearing officer rules on whether the firing was justified.
However, to avoid self-incrimination, arbitration hearings can’t be held for teachers until the criminal case concludes.
A bill drafted by state Rep. Chad Fincher, R-Semmes, would automatically revoke the certification of teachers convicted of felonies or crimes involving children.
Washington County teacher Charlene Schmitz was convicted of soliciting sex by cell phone and computer with a 14-year-old male student at Leroy High School in Washington County.
Schmitz, 56, still faces rape and sodomy charges involving the same student. The school terminated Schmitz in May 2008, but because she appealed the firing, her $51,000 pay plus benefits and added credit toward retirement continue, totaling more than $70,000 so far.
