Sedona man accused of throwing bag of body fluids on guard faces aggravated assault charge www.privateofficer.com

 

Prescott AZ July 4 2012  Police booked John Cody Newton, 25, of Sedona into the Yavapai County Jail June 21 on felony charges of aggravated assault and disorderly conduct after witnesses told police that after security guards wheeled Newton outside the hospital for yelling profanities, Newton threw a bag containing his saliva at a Yavapai Regional Medical Center security guard and some of the contents landed on the guard’s arm.

At 9:39 p.m., officers who answered the call spoke to four witnesses who told them Newton repeatedly yelled profanities in front of children and other patients in the hospital’s waiting room.

A nurse at the admitting desk told officers that a person brought Newton to the emergency room saying Newton was drunk. Soon after Newton gave the nurse his name and date of birth, Newton started yelling at the people who brought him to the hospital, so two security guards took Newton to another room where he reportedly continued to yell profanities, and security guards then wheeled him outside.

When the nurse at the admitting desk went outside to tell the guards Newton could be moved to the emergency room, he found the bag with saliva in it on the sidewalk in front of the emergency room doors and an empty wheelchair, so he threw the bag in the trash and moved the wheelchair back inside, then noticed that police officers were with Newton, and the security guards outside.

When an officer spoke to Newton, Newton said he did not understand his rights, then told the officer that he was rude and disorderly, but did not hurt anyone, according to the police reports.

Newton took a portable breath test and blew a .304 breath alcohol concentration, according to the police report.

After Newton was medically cleared, an officer took him to the county jail.
