SELBYVILLE DE Dec 31 2011 – A 26-year-old security staff member at Pomeroy’s Tavern on DuPont Boulevard was sent to the hospital after he was struck in the head with a chair during a 100-person melee in the early hours of Christmas Eve.

Police said the fight originated inside the tavern at approximately 1:30 a.m., at which time the owner of the tavern sprayed the entire bar and club area with pepper spray in an attempt to force everyone outside.

According to police, approximately 100 disorderly people continued to fight in the venue’s parking lot.

Multiple police agencies responded to assist the Selbyville Police Department, including Delaware State Police and units from Millsboro, Ocean View, Bethany Beach and Fenwick Island.

The victim was transported to Atlantic General Hospital due to a head laceration that required stitches. He was treated and released later in the morning.

No suspects have been identified at this time.

Police Chief W. Scott Collins said the location has been a trouble spot in the past. As recently as last fall, fights at Pomeroy’s were considered by police to be a weekly occurrence.

“We have had multiple fights like this at this location off and on for the past year,” he said.

Collins said there was a point in time at which it was bad enough that police had meetings with the owners of the restaurant and their attorneys to discuss issues such as security staffing and loitering.

“They’ve done a good job of policing their own issues, which was nice,” he said. “That really made a huge difference.”

Police activity at Pomeroy’s had slowed down “quite a bit” during the past few months, Collins said, but within the last month and a half, there have been two incidents at the tavern.

The fight took place as the Selbyville Town Council considers a code amendment that would prohibit the sale of alcoholic beverages in town restaurants after 11 p.m. and consumption after 11:30 p.m. The sale and consumption of alcohol would resume at 9 a.m. the following day.

The amendment is being considered because the council thinks there is a link between late-night alcohol sales and illegal and offensive conduct.

The amendment went to a public hearing Dec. 5 and was then tabled by the council. The issue is not on the agenda for the next Town Council meeting, which is scheduled for Jan. 9.
