A quirk of Tennessee’s criminal background checks allowed a rape suspect to be hired as a teacher in Metro Schools.
Ronald Boykin, 40, was arrested March 22 in Nashville on two counts of rape, one count of sexual battery by an authority figure and one count of attempted sexual battery by an authority figure dating to 2005, when he was working in a Chattanooga high school. A Donelson Middle School teacher hired by Metro Schools in 2007, he was picked up after a routine traffic stop turned up the charges.
Three background checks on Boykin initiated by Metro Schools did not detect the outstanding warrants, said Noelle Mashburn, spokeswoman for the district. The most recent check was in October.
That’s because background checks run for school districts do not include warrants, said Tennessee Bureau of Investigation spokeswoman Kristin Helm.
“A fingerprint-based criminal history for a teacher is what’s statutorily required,” Helm said. “There is no Tennessee database that can be searched for outstanding warrants unless you’re in law enforcement.”
Also allowing Boykin to slip through the cracks: Tennessee’s teacher database, which flags educa
tors who have committed serious offenses, doesn’t include those without teaching licenses. Boykin’s job in Chattanooga didn’t require a license.Boykin was returned to Hamilton County this week, but Metro police say they have identified at least two Nashville students who say Boykin touched them. Police are investigating more cases and are asking Donelson Middle parents to contact 862-7540 if they have any information.
No charges against Boykin have been filed in Nashville.
He is the second Metro Schools teacher arrested on sex-related charges this month. Ronald B. Anderson, executive principal of Kennedy Middle School in Antioch, was arrested March 6 on 12 counts of sexual battery by an authority figure. He was charged with sexually abusing two teenage boys from his church years ago.
Boykin, who taught a behavior program for struggling students, was busted for making an illegal left turn onto westbound Interstate 24 from the Second Avenue on-ramp, police said.
Officers discovered his license was expired and ran an in-depth check, which turned up the warrant in Hamilton County.
In 2005, Boykin was suspended from his job as an educational assistant at Brainerd High School after police launched an investigation into misconduct that occurred before the start of school. A warrant for his arrest was issued in
2006, according to Metro police.
School districts that request background checks get a nationwide search of any records the FBI holds that contain the fingerprint of the applicant, so a report is generated any time they’ve been fingerprinted and arrested in the United States.
Until this week, Boykin had never been arrested on the Chattanooga charges.
Criminal warrants are contained in a name-based database called the National Crime Information Center or NCIC, commonly used by officers during investigations or traffic stops.
Serious offenses against teachers must be reported to the state Board of Education and are tracked in a statewide database available to other Tennessee systems and the public. But it only applies to licensed educators, which at the time of the Chattanooga incidents Boykin was not.
Records show that Boykin did not request a teaching permit until 2007. The next year, he was granted an alternative teaching license.
Mashburn, the district spokeswoman, said she did not know the status of Boykin’s employment, adding that he would not return to the classroom until the investigation was complete.

Investigators did not provide further details on the arrest other than to confirm it.Police spokeswoman Ann Hope said Ewing has been with the department for four years. She said he has been “relieved of his duties.”
There was also no word on whether or not Ewing posted bail yet.

Authorities say the offer sounded simple but chilling.
“She was driving on a revoked license, and he made a deal that he wouldn’t arrest her if she did the evil deed for him,” LaFollette Police Chief Ben Baird said. “He told her she had to have sex with him, and he’d let her go. I guess the arrest went the other way.”
Jeremy S. Cross turned himself in Tuesday to face charges of raping a woman at gunpoint during a traffic stop.
A Campbell County grand jury indicted Cross, a former LaFollette police officer, last week on charges of aggravated rape, official oppression and two counts of official misconduct.
Cross had worked for the department for about three years when he pulled the woman’s car over July 5 on North Tennessee Avenue, Baird said.
Authorities said Cross forced the woman to have sex with him behind some warehouses on nearby Howard Armstrong Lane under threat of arrest if she refused.
“There was a patrol rifle in the seat, and he would have been carrying his service weapon,” the chief said. “He apparently cut his (incruiser video) camera off, which is a violation of our rules and regulations.”
Baird said he called in the Tennessee Bureau of Investigation the same day he learned of the woman’s complaint.
“It happened on a Friday,” the chief said. “She filed her complaint on Monday around 2 p.m. By 4 p.m., we had the TBI investigating.”
He said he didn’t know whether TBI agents recovered DNA evidence from either car.
Cross resigned soon after the investigation began. He’d previously worked as a deputy in neighboring Scott County and had no history of discipline problems other than a few minor write-ups for such offenses as showing up late for court, the chief said.
“I’m going to send a message to everybody that I don’t tolerate this sort of behavior from anybody. It’s a stain on everybody who wears a badge up here.
“We have 20 other people in this department, and most everybody here is very professional. If they’re not, I don’t keep them long.”
Cross remains free on $50,000 bond.
He could make his first court appearance Sept. 8.

The campus police department along with the Clarksville police are investigating the assault that they say took place when the victim was visiting a residence hall early Sunday morning .
Investigators say that there were at least two attackers but released few other details of the incident.
It was unclear whether the victim attends Austin Peay, but students and staff were notified of the attack through text messages and e-mail.

Creston Police Chief James Alan Christensen, 40, and assistant chief John West Sickels, 38, are charged with second-degree sexual abuse. The charges allege that a forced sex act was committed while being aided or abetted by another person. Both men surrendered Friday.
In an affidavit, Iowa Division of Criminal Investigation agent David Dales detailed what happened during the alleged assault at the Crestmoor Golf Club in the early morning hours of April 18.
It said that Sickels and Christensen were the only customers at the club’s bar around closing time when Sickels requested that a female employee perform a sex act on both men and she refused.
The men allegedly blocked the woman’s exit from the bar area and then Sickels left that area apparently to lock the door to the country club. Upon his return Sickels had forced sexual intercourse with the woman while Christensen “held her hand, stroked her hair and ‘shushed her,”‘ the affidavit said.
It said the woman repeatedly told Christensen that what was happening was wrong, and that he knew it was wrong.
Attempts to reach attorneys for the two officers were unsuccessful.
Sickels was interviewed by state investigators last month and initially denied any physical contact with the woman. He later admitted having intercourse with the woman but claimed it was consensual and said that he doubted Christensen had witnessed the act, the affidavit said.
When Christensen was interviewed, he initially denied that he or Sickels had any contact with the woman. Later, he admitted that he saw Sickels having sex with the woman and that during the act he touched her hand. The affidavit said he also admitted that the woman had expressed that she did not consent to have sex.
Bail has been set at $25,000 each for Sickels and Christensen. If convicted, they face a maximum prison sentence of up to 25 years.
The Iowa attorney general’s office said it is prosecuting the case at the request of the Union County attorney’s office. The Division of Criminal Investigation has handled the investigation.
Warren Woods, mayor of the town of about 8,000 located 70 miles southwest of Des Moines, said the police chief and his assistant have been on administrative leave for about a week, adding that the city is evaluating what to do now that both men face charges. The fire chief has taken over administrative duties for the Police Department, which is comprised of about a dozen officers, Woods said.
The state patrol will provide backup if needed, he said, adding that all the police shifts are being covered.
“Our police department is in place. We have good officers on the ground,” he said.
A woman who answered the phone at the Crestmoor Golf Club declined to comment.
Alma Swanson, owner of Fiscus Diamond Jewelry and Gifts in Creston, said rumors “have been flying” around the community for several weeks.
“It’s just totally blown us all away,” said Swanson, who said she knew Christensen. “I’m still just totally amazed. It’s kind of hard to believe.”
Swanson called it a sad situation and said she’s trying not to jump to conclusions.
“There are a lot of things I’m sure that will be uncovered and/or discussed when this comes to trial,” she said.
Jim Saunders, a spokesman for the DCI, said the case was an isolated incident among law enforcement and that Sickels and Christensen are being held accountable.
“I think it goes without saying that when something like this happens it’s kind of a blow to the public trust that law enforcement tries to maintain in the community,” he said.

Halls TN. April 18 2008 – Police say that a Halls High School teacher has been arrested on charges of sexual battery and statutory rape of a female student.
Deputies and investigators arrested Corey Dehart, 43, Wednesday after investigating a complaint that they received from a student about sexual activity with a teacher at the school.
The student told authorities Dehart sexually assaulted her in 2007.
A Knox County grand jury indicted Dehart on the charges Tuesday.

TACOMA, Wash. Nov. 26 2007
– A retired Tacoma Police officer and his girlfriend pleaded guilty to child rape and molestation charges Monday morning.
Lee William Giles, Jr. and Maureen Wear face at least 20 years in prison, and Giles could end up behind bars for life. Police say that during their investigation officer giles retired and was arrested soon after.
Both pleaded guilty to first- and second-degree child rape, first-degree molestation and third-degree child assault.
Prosecutors contend the Giles and Wear molested young relatives for years and videotaped some of the abuse.
The victims told prosecutors they supported the plea deals.
Wear will be sentenced in late December. Giles will be sentenced January 4.

An immigration agent driving a Jamaican woman from a Miami-Dade detention center to one in Broward took her to his home instead and raped her, according to federal criminal charges filed late Friday.
A criminal complaint filed in Miami federal court alleges that Wilfredo Vazquez, 35, a U.S. Immigration and Customs Enforcement agent, sexually assaulted the 39-year-old Jamaican mother of two on the afternoon of Sept. 21 at his Tamarac home.
The woman said she was ”afraid” of Vazquez, according to the three-count criminal complaint. She “emphasized that Vazquez was wearing his firearm at all times, and she did not know what he was capable of doing to her.”
Federal authorities are poring over computer records and other documents that track Vazquez’s involvement in previous detainee transfers to see if other women were attacked but feared coming forward.
Vazquez, who worked for the agency for less than a year as an immigration enforcement agent, was picked up Friday evening in Tampa, where he had been on rotation with an unidentified military reserve unit. He is scheduled to make his first appearance in Tampa federal court on Monday.
Cheryl Little, executive director of Miami-based Florida Immigrant Advocacy Center, which represents the victim, said the woman was released from immigration detention Nov. 1. The Miami Herald, as a policy, does not identify rape victims.
”I was scared for my life,” the woman said in a telephone interview before being released. “He had a gun. He’s a big man, and I was in his custody. I expected him to protect me, not to take advantage of me.”
Little said the woman cried with relief when told Friday night about the arrest.
”It was such an emotional moment when I told her,” Little said.
Vazquez denied several times to investigators that the incident happened or that he stopped other than to get gas, according to an affidavit by Homeland Security agent David Nieland.
But records from Florida’s Turnpike SunPass electronic toll system showed Vazquez’s official vehicle left the highway at a Commercial Boulevard ramp near his home, the affidavit said, and the woman described his home and neighborhood to investigators.
The sexual assault case is the first since 2000, when officials at the Krome detention center opened an investigation into sexual misconduct by guards and officers at the west Miami-Dade detention facility.
At least one officer and one contract employee were convicted. The scandal prompted immigration authorities to remove female detainees from Krome. Most women are now housed at the Broward Transitional Center at Pompano Beach, though some are first processed at Krome.
U.S. Immigration and Customs Enforcement issued a statement late Friday saying Vazquez was fired “shortly after the allegation was lodged against him.”
”ICE takes employee misconduct very seriously,” the statement said. “As such, Wilfredo Vazquez was arrested [Friday] following a thorough criminal investigation by the ICE Office of Professional Responsibility, the [Department of Homeland Security] Office of Inspector General and the Broward County Sheriff’s Office.”
The Broward Sheriff’s Office first opened the investigation in late September after the victim disclosed the episode to authorities. The U.S. attorney’s office in Miami then developed the case under prosecutor Daniel Rashbaum.
The Jamaican woman was being processed at Krome for transfer to Pompano Beach after being sentenced to time served in connection with a false claim to U.S. citizenship. Immigration officials planned to put her in deportation proceedings after having lived in in the United States for 12 years. She has a 20-year-old daughter and a young son.
She was at Krome’s intake room when Vazquez noticed her among a crowd of male detainees, according to a statement she gave to her attorneys.
In that statement, the woman said the officer told intake officials he would drive her to the Pompano Beach facility. Then he turned to the woman and said: “I’ll rescue you, so you don’t have to wait for them to process all the men.”
Before putting her in the back of a van, Vazquez took the handcuffs off the woman and allegedly said: “I don’t cuff females.”
A Broward Sheriff’s Office report said Vazquez later stopped the van, after asking the woman if she was hungry, and said: “You can sit in the front if you are going to be a good girl.”
Vazquez then asked the woman if she needed to make a phone call, handed her an earpiece and dialed calls to the woman’s daughter and a friend.
After she finished the calls, the officer asked her if she was wearing ”federal underwear” and to show it to him. ”I told him no,” according to the statement.
Later, the officer called his wife on his cellphone to check if she was at home. ”He told me that she was not,” the woman said in the statement.
Inside his home he asked her to “take off those federal clothes.”
‘I just stood there praying to myself, saying, `God, please don’t let this man hurt me.’ I was asking God to have mercy so this man wouldn’t kill me. . . . All I could think of was . . . if he was crazy enough to bring me to his house and rape me, then what would he be willing to do to cover it up?”
After about 15 minutes, the agent ordered her to get dressed and walk to the van.
She noticed a van parked across the street with lights on.
”I thought about running over there and screaming for help,” she stated. “But then I thought he might just shoot me in the back and say that I tried to escape from him.”
After arriving at the Broward facility, the woman was taken to her room. “I just laid on my bed in the fetal position crying.”
A short time later, another Jamaican female detainee asked why she was crying. The woman shared what happened. The next day, the other detainee reported the conversation to facility officials, who took the victim to the BSO and a treatment center.
The woman told The Miami Herald that she keeps replaying the episode in her mind and wondering whether she could have done something to prevent it.
‘I keep thinking, `What could I have done to stop him?’ ” she asked.

— A woman who was abducted at the Galleria and sexually assaulted has won a civil lawsuit against the mall and its security firm.
A Harris County jury on Thursday awarded the woman more than $3 million in damages stemming from the 2003 attack in a parking garage at the luxury shopping center.
The victim, who worked at the mall, sued the Galleria’s parent company, HG Shopping Center, L.P., and its security provider, IPC International Corp.
The suit accused the shopping center and the security company of not warning employees that a predator had attacked other women in the mall’s parking garages that summer.
“It’s a wake-up call to the Galleria that you need to enhance your security,” said the woman’s attorney, David Matthews. “When you know there’s a pattern of crime in the parking garages you must warn employees and customers.”
Joe Garnett, an attorney for IPC, said the firm is considering its options, including an appeal. HG’s attorney could not be reached for comment.
Juan Reyes Solis, 24, was convicted last year of aggravated sexual assault and sentenced to 80 years in prison for the attack on the woman.

KANSAS CITY, Mo. Nov. 5 2007– A woman was allegedly attacked and forced to beg for her life in her home by someone she knew, police said.
KCTV5′s Ty Wilson reported that police said the two definitely knew each other. The alleged attacker is a security guard in a posh downtown condominium building where the victim lives.
The security guard was arrested and booked into the Kansas City, Mo., police headquarters building and is accused of attempted rape, police said.
On Sunday, some residents, who call The View, a pricey upscale downtown condo building, home, said they are in shock.
KCMO police said Mark Finley, 21, a security guard at The View, tried to rape a 44-year-old woman who lives there.
Residents called the act “despicable,” and said they want answers from the building’s management.
Police said the victim woke up at about 3 a.m. on Sunday to find Finley on top of her.
According to police the report, Finley put a box cutter-type knife to her neck and tried to force himself on top of her.
Police said Finley eventually grabbed the knife, a rung of building keys, his cell phone and a backpack and left.
Police said when they got to The View, Finley came out of the building with his hands up in the air and said, “I give up.” He also told them he needed a lawyer, police said.
Finley’s bond is $200,000 cash only, authorities said.

ORLANDO, Fla. Nov. 3 2007 — A 14-year-old boy is accused of random sex attacks on five women. A tip from inside the Orlando Police Department revealed the accusations against the boy before he was even charged.
Several of the women were attacked in the parking lot of a Publix store on State Road 436 in the Conway area. One woman said the boy even tried to rape her.
Detectives say the Boone High School freshman is in custody and they are in the process of charging him with attempted rape. The 14-year-old reportedly looked for women who were walking to their car and, while they were unloading their groceries, he attacked them.
Orlando detectives say 14-year-old Malik Gaither attacked five different women in the Publix parking lot on Semoran Boulevard. He preyed on women who were shopping in the grocery store. According to police reports, the teenager used a fake BB gun to scare his victims.
Meredith Sena works at a Publix and told Eyewitness News one of her co-workers was attacked in the parking lot.
“He was in our parking lot and I guess she was getting out of work and I guess he touched her,” Sena said.
But detectives said it didn’t stop there. In one case, while a woman was unloading her groceries, detectives said Gaither walked up behind her and grabbed her rear. He then pulled out a fake BB gun and tried to carjack her. The woman screamed for help and Gaither took off.
While running away, police said, Gaither spotted a second victim near the Regency Garden Apartments in Conway. Deputies said he grabbed the woman, stuck the BB gun in her face and told her he was going to rape her. The woman fought with the teenager and was able to get away.
The Boone High School teenager was arrested for battery charges. Now other shoppers are worried the teenager will get released and target women again. Publix employees told Eyewitness News extra security has been added in the parking lots.
