Teacher charged with sexual assault of 14 yr old student www.privateofficer.com

Marcellus NY Sept 18 2010 – Onondaga County Sheriff’s Deputies have arrested a substitute teacher in Marcellus who they say had sexual contact with a 14-year-old boy.

Floyd Bailey, 70, of Kinderwood Lane in Marcellus, has been charged with a felony criminal sex act and two misdemeanors, endangering the welfare of a child and sexual abuse.

The Marcellus School District issued letters to each of its students to bring home to their parents. The letters explain the nature of the situation and the investigation by the Sheriff’s Office. Additionally, the school district is providing counselors to students to specifically address the situation.

Bailey was an elementary school level art teacher in the Marcellus district for 30 years before he finally retired in 1995. Since then, he has been a substitute teacher as the elementary and middle schools. Superintendent Craig Tice noted that Bailey has been removed from the substitute teacher list pending the results of the Sheriff’s Office’s investigation.

According to Tice, the suspect has been a respected teacher in the school district. “Like I said, we were totally shocked when we received that information,” he said.

According to an affidavit, Bailey admits that the sexual touching went on in the summer of 2008 at his home on Kinderwood Lane. According the statement, the boy told Bailey he was curious about his sexuality and sex. Later that summer, Bailey says the two had sex once.

Last month, the boy’s mother became suspicious when she saw e-mails to her son. She says it seemed as though Bailey was attempting to make arrangements to meet with him.

The Sheriff’s Office has confirmed that the victim is a student in the district.

Bailey was arraigned in the Village of Marcellus and has posted $10,000 bond.
