Shoplifter dies in high speed police chase www.privateofficer.com
Kenneth Stephen Carter, 37, died after police said driver Eliot Alfred Carvajal, 37, led police on a vehicle chase reaching 80 mph and slammed into a telephone pole about 20 miles from where the incident began .
The chase brought out three different law enforcement agencies, sent three people to the emergency room and killed another person when the car crashed into a telephone pole about
It all started as a shoplifting incident at the Walmart at 12900 I-35 when police said they were called about a theft.
According to the Travis County Sheriff’s Department, an employee at a North Austin Walmart suspected a man of shoplifting.
Police said when they got there, they saw three men eluding them in a 2001 blue Honda Accord and traveling through lights at speeds up to 80 mph. After 20 minutes of pursuit, the suspect’s car – with four people inside – crashed into a telephone pole right in front of Spec’s off 290 and Mopac .
The impact killed Carter and injured three others: Hiram Espitia, 23; Gary Powell, 18; and Carvajal.
Espitia was taken to University Medical Center Brackenridge with life-threatening injuries, while Powell was treated at the hospital and released Tuesday.
Meanwhile, officials released Carvajal Wednesday after he was treated. Authorities have charged him with the second-degree felony of intoxication manslaughter and evading arrest, a third-degree felony. He is currently in custody.
The pursuit ended up involving Sunset Valley and Austin police. Authorities said the investigation into the crash is not complete and that other charges are still possible.

Security guard charged with murder in Florida www.privateofficer.com
A man barged into his ex-girlfriend’s Coconut Creek home on Saturday, stabbing her and killing a friend when he tried to protect her, police said.
Paul Gayle, a 28-year-old security guard with a state-issued weapons license, was charged with first-degree murder, attempted first-degree murder and armed burglary.
Coconut Creek police said Joy Stewart, 36, ended her relationship with Gayle last week and was spending Friday evening with a friend she recently met: 32-year-old Hasting Clarke.
But shortly after midnight Saturday, Gayle showed up at Stewart’s home on the 4100 block of Northwest 43rd Way.
He was planning to carry out a threat he’d made Thursday, said Detective Angela Hofer, a police spokeswoman.
After barging in, Gayle cornered Stewart in a room and stabbed her several times — but Clarke walked in to save her, Hofer said. Stewart seized the opportunity, grabbing a cordless home phone and driving off in her car while calling 911. Seconds later, she flagged down Officer Alejandro Escobar, who found her wounded and frantic.
He and three other officers rushed to her house and arrested Gayle, who was trying to get back into his car, police said.
They also found Clarke, who was killed during the fight.

KY physical ed teacher accused of student relationship www.privateofficer.com
Coach Michael “Eddy” Wilson taught physical education and coached girls basketball at Butler High School for several years with a good record, but recently, JCPS records indicate parents began coming forward with allegations they were hearing from their children about a relationship between Wilson and an unidentified student.
Parents and students registering for classes at Butler Monday were shocked by the allegations. “Teachers, in my perspective, are there to teach me, not to do anything more,” said Tachae Sowell, an incoming freshman at Butler.
“It’s sickening, and it’s scary too,” said Thereasa Sowell, Tachae’s grandmother.
After reviewing the complaints, JCPS spokeswoman Lauren Roberts said school officials conducted an investigation.
“We did, after reviewing records and evidence, confirm that there was indeed an improper relationship with the student,” Roberts said. “I know everyone is asking does that mean there was a sexual relationship – we were not able to verify that. But there was indeed, based on phone records, an inappropriate relationship under way between the two of them.”
And according to cell phone records, the student and Wilson exchanged more than 555 text messages and calls totaling more than 5,000 minutes from December 2008 to April 2009 – and many of those calls and texts were after midnight.
JCPS’s investigation also revealed that Wilson allegedly took the student on a ski trip to Paoli Peaks in Paoli, Indiana, and that the two reportedly spent a lot of time together after school hours.
The investigation took an unexpected twist, Roberts says, because “students were being charged $3 to not participate in some activities such as running; and then in a couple of cases, there were some students who said their grades were improved based on paying. At least 100 students were able to tell us they paid money or had knowledge of others who tried to get out of class.”
According to the investigation, school officials found over $1,000 in Wilson’s desk. Wilson said he was going to use the money to pay the basketball team’s expenses.
Students registering for Butler told us they’re relieved Wilson won’t be there this year.
“I like gym, and I don’t want a teacher looking at me that way,” Sowell said. “I don’t’ like that type of attention from an adult.”
In a statement given by Wilson to JCPS, he said that he was just being a mentor to that student.
Wilson was hired at Butler in 2003, and had no previous disciplinary problems or complaints before being fired last week.
JCPS has notified Child Protective Services about the issue.

Police charge man with shooting Fla wildlife officer www.privateofficer.com
Police said 23-year-old Christopher Eddy was arrested after he was found hiding in a sand dune on Melbourne Beach.
FWC Officer Van Streety, a 10-year FWC veteran, was patrolling near the intersection of Satellite Boulevard and State Road 520 in Brevard County when he was shot multiple times during a routine stop.
“If I wanted to kill him, I could have,” Eddy said after he was arrested. “I shot him in his vest on purpose.”
Streety was saved by a bulletproof vest — and a special coin he had in his pocket, which helped stop one of the bullets. (See Images Of The Coin)
Police said Eddy was stopped by the officer, a struggle started and, according to reports, Eddy pulled out a gun and shot the officer several times.
Streety was attempting to arrest Eddy for warrants issued from Brevard County for multiple traffic violations, officials said.
Eddy said he shot the officer during the routine traffic stop because he had prior traffic tickets and had a warrant out for his arrest for driving without a license.
“I felt my freedom was being violated,” Eddy said. “It was just unjust they way they treated me. They pulled me over, gave me some traffic tickets and sent me right to the court.”
Investigators said they’ve been putting the pressure on Eddy and apparently he couldn’t take it anymore. They said he made one big mistake leading to his capture on Friday when he tried to steal a car from an armed neighbor.
Investigators said they brought the 46-hour manhunt to an end with “luck, intensity and aggression.”
Police said when Eddy tried to steal the car and he was approached by the armed homeowner, Eddy took off running.
“He kept yelling out to the homeowner, ‘I’m homeless, I’m homeless,’” said Brevard County Sheriff’s Office Major Andrew Walters. “You could see he was bug-bitten, but he did see a firearm.”
Walters said when police found Eddy, the fugitive emerged from the sand dunes and turned himself in.
“He led them to a makeshift camp he had been staying in and showed them the firearm,” Walters said.
On Thursday, Eddy’s girlfriend was arrested and is still being held in a Brevard County jail without bond.
A judge said that any attempt on the life of a law enforcement officer “tears at the fabric of our society” and that he wanted her to stay in jail until she comes before a jury on charges of accessory to attempted murder of a law enforcement officer.
Tammi Temple, 37, was arrested Thursday, the same day that what was later identified as a shrapnel bomb was found at her home.
Police found the shrapnel bomb when they served a search warrant at Temple’s home in Melbourne in connection with Wednesday night’s shooting of the FWC law enforcement officer.
Investigators said Temple was in the car with Eddy when he shot the officer. Police said she didn’t come to Streety’s aide but rather helped Eddy get away. Deputies said Floyd Johnson helped Eddy escape, as well. He has been charged with being an accessory after the shooting.
“All I want is a peaceful life,” Eddy said. “I just want some freedom. I guess I’ll never get out of jail for this dumb (expletive).”

Woman faces robbery charge in shoplifting incident www.privateofficer.com
A simple case of shoplifting turned violent Sunday afternoon, landing a Big Spring woman and local juvenile behind bars, according to law enforcement officials.
Ruthie Marie Murphree, 39, of 800 W. Marcy Apt. 22, was arrested Sunday on a charge of robbery after she and a 13-year-old suspect allegedly attempted to leave the Wal-Mart SuperCenter without paying for their items.
According to Sgt. Tony Everett, public information officer with the BSPD, a security official with the store’s asset protection department attempted to stop Murphree and the juvenile in the store’s parking lot when things became violent.
“The call came in at the police department at approximately 3:39 p.m.,” said Everett. “Apparently, the person with the store’s asset protection department had spotted the two women stealing and confronted them about it in the parking lot. The altercation became physical, which upgraded the crime from theft to robbery.”
Everett said no major injuries were sustained as a result of the altercation, and no one was transported by ambulance.
Both subjects were arrested and charged with robbery, according to Everett. Murphree was booked into the Howard County Jail later in the day.

Police investigate dead body at Alabama Wal-Mart www.privateofficer.com
Cullman police have identified the woman whose body had been sitting in a parked vehicle for two days prior to its discovery Monday.
Sgt. Billy Handley of the Cullman Police Department identified the victim as Patricia Glasscock, 48 of Hanceville.
According to police reports, Glasscock’s body was discovered at approximately 3:30 p.m. in a brown, 1999 GMC pickup truck parked in the Wal-Mart Super Center parking lot by a local citizen.
“We believe she had been parked down there since early in the morning on May 2,” Handley said.
Handley said investigators would soon review the outside security video at Wal-Mart to possibly learn more details about Glasscock’s final hours.
Though the cause of Glasscock’s death has not yet been determined, Handley said investigators were not treating the incident as a homicide.
Cullman County Coroner Gary Murphree said the body would be sent to the Alabama Department of Forensic Sciences for an autopsy to determine the cause of death.
Capt. Jimmy Rodgers of the Hanceville Police Department said Glasscock’s family reported her missing Saturday. Glasscock was reportedly last seen on County Road 634 in Hanceville.
“She’d had some suicidal issues in the last couple of months and they (family) hadn’t spoken to her in the last couple of days prior to the report,” Rodgers said.
Family members did not know why she was at Wal-Mart.
“She wasn’t a Wal-Mart employee,” Rodgers said.

douglasdispatch.com — Two Douglas men are accused of shoplifting after they were caught with merchandise from four area stores in their car on Friday.
Brandon M. Arevalo, 23, and Joseph G. Arvizu, 19, both of Douglas, allegedly stole a digital camera from Walmart in Sierra Vista around 12:30 p.m. by cutting the cable securing the item and then fled the scene with the camera, according to a Sierra Vista Police report.
Police spokeswoman Officer Tracy Grady said the two men returned to the store around 2 p.m. and were watched by security personnel who saw Arevalo and Arvizu allegedly attempt to steal two flat screen televisions. Their attempt to take the TVs “out through the garden center part of the store was unsuccessful,” Grady said.
The two suspects then went to their car and were driving out of the parking lot when they were stopped by Sierra Vista police, she said.
It was then the “plain sight doctrine,” came into play, the spokeswoman said.
Articles seen with in a person’s sight can be used to help build a case if a crime is suspected and other merchandise is seen, Grady said.
The items from three different stores at the Mall at Sierra Vista that were in the car also were reportedly shoplifted, she said, adding that during the search of the vehicle a concealed weapon was found
Dillard’s, Famous Footwear and Spencer Gifts were the three mall stores involved.
The two have been charged with shoplifting, attempted shoplifting and carrying a concealed firearm, Grady said.
Arevalo and Arvizu were taken to the Cochise County Jail facility in Sierra Vista where on Monday they were each being held on a $4,000 bond.

Multi-state scam ring busted www.privateofficer.com
An arrest at a Wal-Mart in Austin, Minn., may help break a multi-state scam wide open.
Police arrested a woman who they believe tried to scam the store out of thousands of dollars. Her arrest is linked to a retail scam that stretches across several states.
Investigators say the scam has grown into a major theft ring. Once the suspects buy the merchandise with fake checks, they try to unload it before stores even know they were scammed.
Austin Police arrested 21-year-old Ashley Smith of Rochester at a Wal-Mart late Tuesday afternoon. Officers say she was trying to return close to $2,000 in merchandise bought with a bad check the day before at a store in Sauk Centre.
“An alert employee was suspicious about the return and started doing a little checking,” said Austin Police Chief Paul Philipp.
That checking revealed the Minnesota Financial Crimes Task Force has been investigating a theft ring involving retail stores statewide.
Investigators say stores in Alexandria, Detroit Lakes, Pine City, Sauk Centre, Austin, Rochester, Worthington, Fairmont and even some stores in northern Iowa were all hit with the same scam. They’re all located along major interstates.
So far, investigators believe more than $50,000 in merchandise is involved.
“She knew what she wanted to do and how she wanted to do it and it was just part of an ongoing process for her,” Philipp said.
Investigators with the Minnesota Financial Crimes Task Force say the crime extends beyond just Wal-Mart stores, but because of the ongoing investigation they could not release any additional details.
Smith isn’t telling investigators much but the police report details other potential suspects from all over Minnesota. So far though, no one else is in custody.
Wal-Mart didn’t want to comment on this investigation but says the arrest is likely the result of extensive training for employees in hopes of spotting fraudulent activities.
Police say Smith is being held in the Mower County Jail.

Waterloo man’s unusual way to get TVs out of Wal-Mart landed him in the Polk County Jail this week.
On Aug. 1, store security camera footage shows Ford pushing a cart filled with six TVs into the garden section of the store. On Aug. 22, Ford tried the same trick with four more TVs, a police report said. The value of the 10 TVs was $3,468.Police believe the plan was for Ford to drive around to the building’s edge and steal the TVs.But off-duty police officers and Wal-Mart security on both occasions discovered the TVs with damaged boxes before Ford could make it back to the loot.
While the store recovered the TVs, Ford proved more elusive.Sgt. James Butler, working off-duty at the store, spotted the license plate number of Ford’s vehicle on Aug. 22 and requested a warrant for his arrest, the report said.Marshalltown police eventually arrested Ford on Wednesday. He was being held in the Polk County Jail on $15,680 bond.Because of the incidents, Wal-Mart has changed the way people check out some kinds of merchandise, police said.

metrowest daily news
A Framingham woman and her niece laughed while they packed a bag full of stolen makeup and CDs at Wal-Mart on Wednesday while the woman’s two children watched, police said.
Josephine A. Washburn’s attitude changed when a police officer said he was going to contact the state Department of Children and Families because she was committing a crime in front of her children, police spokesman Lt. Paul Shastany said.
“Josephine pleaded with the officer, ‘Please don’t arrest me. I’ll never do it again,”‘said Shastany. “She didn’t understand why it was neglectful.”
Store security called police around 6 p.m. to report they had two shoplifters in custody.
They told Officer Val Krishtal they watched Washburn, 43, and her 16-year-old niece, fill a bag with makeup and classic rock CDs from the 1970s, such as Foghat, Janis Joplin and Deep Purple, Shastany said. The total price was a little less than $143.
“They were obviously putting the items in the bag while Josephine’s 10- and 12-year-old daughters watched,” he said. “It appeared they were both laughing as they were doing this.”
The group went through the checkout aisle where Washburn paid for $8 worth of goods. Security stopped them with the stolen items.
Washburn and the 16-year-old girl, who was on probation for shoplifting in Natick, were charged with shoplifting of property worth more than $100.
Washburn’s children were picked up by a relative, and the police contacted the state.
Washburn, of 7 Lexington St., pleaded not guilty at her Framingham District Court arraignment yesterday, and was released without bail. She is due back in court on April 17 for a pretrial conference.

A Lowndes County Grand Jury indicted 25-year-old Charles McDowell on three counts of child molestation, said Valdosta Police Department Cmdr. Brian Childress.
Police initially arrested and charged McDowell with disorderly conduct; he received the additional charges after the Valdosta Police Department consulted with the District Attorney’s Office for presentation to the grand jury, Childress said.
“We have witnesses who reported that he was fondling his genital area in the presence of a child, who has been determined to be his daughter,” Childress said. “The Division of Family and Children Services was notified of the situation, and the child has been handed over to her natural mother.”
Childress added that the disorderly conduct charge has been moved to superior court with the molestation charges.
At approximately 1:20 p.m. Wednesday, Feb. 18, a victim said she was shopping in a grocery aisle when a man pushing a cart with an infant girl approached her and said he had to ask her a question. The man reportedly wore Superman pajama pants and a Hooters T-shirt at the time.
“When I turned my attention to him,” the victim told The Valdosta Daily Times, “he pulled out some boxer shorts and asked me if I thought they were big enough to fit ‘this.’”
The victim said the man pointed to what appeared to be an erection bulging out of his pants. She said the man did not expose himself.
“I just stood speechless with my mouth open,” the victim said. “He grinned and walked off.”
The victim found a manager and reported the incident, at which time another woman joined in the conversation and said the same thing happened to her and two other women in the store.
The victim said she continued to shop after store management and security were notified of the situation but spotted the man putting the baby in his truck as she was leaving the store parking lot.
“I pulled up behind him, blocked him in and recorded the information on his license plate,” the victim said. “I would not have been so proactive if it had not been for that infant who was with him.”
The victim said she exited the vehicle and screamed for someone to call 911.
“Eventually a crowd grew, and another woman who had been approached by the man began to scream along with me,” she said. “A few minutes later, a Wal-Mart security guard came out and indicated that the man had been asked to leave the store and the property. We could not believe that the authorities had not been notified, especially since four women said he had approached them.”
A Valdosta Police Department squad car arrived, and the officer took statements from the alleged victims. After a brief investigation, the man was arrested and charged with disorderly conduct.

A woman, possibly the officer’s wife,Daniela Gordon, 40, was also charged with the same offense.
Loss prevention agents report that the two purchased about $150 worth of items Tuesday afternoon but tried to steal more than $1,100 worth of items by concealing them under their other purchases and their coats. The report does not identify what the merchandise was.
When a store loss prevention agent stopped them, according to security, the two told them they were just going to their vehicle to get their checkbook. At that point the two were taken into custody and the county police notified.

natchezdemorcrat.com — Another arrest has been made in connection with acts of embezzlement and shoplifting at the Natchez Walmart, and police officials say they expect more to come.
Over the past few weeks, the Natchez Police Department has been working in conjunction with Walmart in making arrests on five cashiers and one door greeter for allegedly shoplifting or embezzling $7,935.94 worth of merchandise.
Now, Angie Council, 21, 101 Highway 33, Fayette, has been arrested on charges of embezzlement for allegedly taking $1,243.48 in goods.
Sgt. Craig Godbold said Council was identified as a suspect through Walmart’s internal investigation, and an affidavit was signed for her arrest on Jan. 27.
“We had been trying to get her to turn herself in,” Godbold said. “(Tuesday) we gave her a choice of either turning herself in or we’d come get her.”
She turned herself in on Tuesday.
Godbold said Walmart is still identifying other employees involved in the scam in which employees are only charged a minimal amount of money for a large amount of items.
Clothes, electronics, food and more have been taken from Walmart at discounted prices in the total amount of $9,179.42.
The employees have allegedly been ringing each other up, but only charging each other for a few items among many.
The items were scanned across the device that would deactivate the barcode, thus preventing the items from setting off the store alarm. But most items were not scanned by the device that charges the items.

Chattanooga police officer suspended over Wal-Mart greeter incident www.privateofficer.com
Chattanooga police officer suspended over Wal-Mart greeter incident http://www.privateofficer.com
Freeman was never charged and contended that Walker assaulted him.
“I wasn’t trying to fight with him. He’s much bigger than me. He’s a big man,” said Walker.
“If you’ve met that man, how in the world can anybody say he was assaulting Kenneth Freeman? It makes no sense,” said Flores.
Freeman was suspended for 28 days by the Chattanooga Police Department on January 26. It’s the longest suspension an officer can receive before termination, but Walker’s attorney says that’s not enough and plans to sue the police department for nearly $20 million.
Flores said their position in the lawsuit is that the City of Chattanooga has a history of overlooking problematic officers.
“When you have an officer or particular officers who constantly are in the eye of internal affairs, and constantly are getting exonerated and then even getting promoted, there’s something wrong there,” said Flores.
Freeman’s attorney has advised him not to speak with the media. But Eyewitness News has learned he plans to appeal his suspension. Walker’s attorney says that lawsuit will be filed in court Monday or Tuesday of this week.
Thursday January 29th
Bill Walker says 28 days without pay is not enough for Kenneth Freeman. Walker says on Christmas Eve when he asked Freeman and another Chattanooga detective to see their receipts as they left the store, Freeman kept walking. Walker says when he when he tried to stop him, Freeman knocked him to the floor and it was all caught on surveillance tape. Walker says he touched Freeman on the arm to get his attention and that’s when he hit the floor and blacked out.
Walker says, ” I wasn’t trying to fight him he’s much bigger than me, he’s a big man.”
Freeman told Chattanooga Internal Affairs investigators that Walker assaulted him. Freeman tells Eyewitness News he wants to give his side of the story but attorneys have advised him against it. Freeman also says he plans to appeal the suspension.
Tuesday January 27th
On December 24, officer Kenneth Freeman reportedly shoved a 71-year-old greeter to the ground and scuffled with another customer who came to the aid of the greeter. You can see the incident on the Wal-Mart surveillance tape. Freeman was off-duty. The greeter confronted him after a security alarm went off as Freeman was leaving with his bags.
After a disciplinary hearing on Monday, Freeman was given the 28-day suspension without pay. Freeman was ruled to have used excessive force, displayed conduct unbecoming for an officer and used improper procedure.

Police responded to a local Wal-Mart after store security said that a Brockton woman was involved in stealing from the store two days in a row.
Police arrested Tracy Simard, 38 at noon on Jan. 13 after store security officers saw her place several digital cameras and a photo printer in a black shopping bag and try to leave the store, police said.
According to police, loss prevention agents stopped Simard as she tried to exit the store with the unpaid merchandise and say that she stole items the previous day while she was accompanied by a man.
Simard’s alleged accomplice, James Deagle, of Brockton, was seen waiting in a car in the store’s parking lot and police confronted the man.
Deagle was also taken into custody on three outstanding warrants and may be charged in the theft incidents.

The two also are suspected of stealing computers from Wal-Mart stores in Fort Smith, Clarksville, Dardanelle and Morrilton, police said.
A spokesman at Wal-Mart Stores Inc. headquarters in Bentonville declined to comment Thursday on the number of computers stolen and the locations of stores involved, citing an ongoing police investigation.
Van Buren police reported that Rodney Wayne Green, 35, and Melody Jane Blankenship, 31, both of Beckley, W.Va., were being held without bond after their arrest Tuesday at an Alma motel.
They are suspected of stealing seven laptop computers from the Supercenter in Van Buren and 11 from the Wal-Mart in Alma, police reports show.
Van Buren police Lt. Brent Grill said Green was captured on a security camera at the Van Buren store taking several computers from the electronics department to the toy department and loading them into a large box containing a toy, then purchasing the toy and leaving the store.
Grill said the security camera showed Green grinning as he wheeled a cart containing the large box from the store.
He said the couple has been in the Fort Smith/Van Buren area for about three weeks and are suspected of stealing a white Toyota in Texarkana, Texas, on Dec. 23.
The break in the case came Tuesday when an employee of an oil-changing business in Van Buren called police after seeing a newspaper article about the thefts.
A man fitting the Wal-Mart thief’s description had the oil changed on a white Toyota and offered to sell an employee a laptop computer that he said he acquired on the docks in New Orleans, the employee told police.
Police in Van Buren contacted Alma police, who began searching local motels for a white Toyota.
They discovered one at the Meadors Inn.
A man and woman got into the car. They were stopped leaving the motel and arrested after questioning.
Officers reported finding empty boxes from the toys purchased in Van Buren, one computer matching those stolen from the store, drugs and drug paraphernalia in the couple’s motel room.
Green and Blankenship are being held on charges of theft, theft by receiving, breaking or entering, possession of a controlled substance, possession of drug paraphernalia and outstanding warrants.
